Ex-MIC Vice President S.S. Subramaniam Defects to Parti KeAdilan Rakyat (PKR)

Read here in malaysiakini

Former MIC vice-president Datuk S.S. Subramaniam has today joined PKR, making him the most senior MIC leader to defect to the opposition.

He was also former parliamentary secretary for Ministry of Trade and Industry.

His defection to PKR came exactly a week after former health minister and prominent MCA leader Chua Jui Meng threw his lot with the opposition party. In June 2009, it was UMNO's Datuk Zaid Ibrahim, a former Law Minister in Abdullah Badawi's Cabinet who joined PKR.

SS Subramaniam also announced that 10 MIC branches in Petaling Jaya would fold and join PKR en masse and would result in a mass defection of about 1,700 MIC members to PKR.

His brother SS Sitaram, who has been a MIC branch leader in Petaling Jaya Selatan, will also be joining PKR.

Earlier at the function, MIC branch leader of Pekan Meru, AR Palaya, told the crowd that he was dissolving his branch.

DAP and Ronnie Liu Should Clear the Air Fast on Latest Allegations on Corruption Linking to Teoh Beng Hock's Death

UPDATE:

Ronnie Liu wrote in his blog "Colour Blind":
"... I will be joining Sdr Kit Siang at a Press Conference tomorrow (25 July 2009, 12.30 pm) on matters relating to the defamatory blog attacking Sdr Ean Yong Hian Wah and me and the Selangor DAP in general.

After having a closer look, I found that the blog (Truth for Teoh Beng Hock) contains nothing but bullshits.

I have put up all details concerning the 2008 allocation for Sg Pelek, Sg Panjang and Pandamaran in this blog in January this year( under annual allocation category)...."
--End of Update --

WE SAY,

The DAP and those named in the blog "Truth for Teoh Beng Hock" should step forward quickly, refute these highly charged allegations of corruption and theft of public funds, and come clean with Malaysians who had all grieved the death of Teoh Beng Hock.

If the allegations in the anonymous blog are a hoax, DAP and those implicated by the allegations should denounce in public with documented evidence.

Whatever the outcomes, we should NOT allow ourselves to lose sight in any way to determine forcefully and whatever it takes, the CAUSE of death of Teoh Beng Hock and to bring in the murderers, if it is a case of homicide.

FACT: Teoh Beng Hock died in the custody of MACC

ALLEGATIONS in a new anonymous blog "Truth for Teoh Beng Hock" :

".. the DAP set up their own dummy companies, create fake invoice, fake projects and then take the money out. This is stealing, not corruption. But because they abuse their power it is also involving corruption. In the process they leave behind a very long trail of documents and evidence.

Teoh was forced into some unscrupulous dealings. He did not like what he was doing. To protect himself, Teoh made copies of false documents, fictitous public work, and dummy companies. He copied information from his notebook and the office computers into a hard disk and left it with someone. Inside are stack of information detailing the corruption by the DAP in Selangor.

The late Teoh Beng Hock was involved in this scandal also but he was forced by Ean Yong and Ronnie Liu. He did not really like what was happening. To protect himself, Teoh made copies of all the false documents and dummy companies that was set up by the DAP. Teoh left behind a hard disk with someone which contains a stack of information detailing the corruption by the DAP in Selangor.

Till today, his death remains a mystery. Why did he stayed back to sleepover at the MACC after the claimed interrogation ended? He is supposed to register his marriage with his fiance that day.

This blog is established in his rememberance. A young man with ideals, belief, and values caught in a web of political deceipt. The blog is also set-up to cleanse his name. May he be remembered for the right reasons..."

Allegations in the blog related to:
  • A total of 84 projects' valued at more than RM200,000 in the Sungai Pelek constituency (seat held by BN's Yap Ee Wah) were awarded to one Wong Chuan How. Wong Chuan How is Ronnie Liu's special assistant while Sungai Pelek is a state seat held by of the opposition Barisan Nasional.
  • Five 'examples' of how state funds for each 'project' were being allegedly siphoned off by several individuals. The five 'examples' were NOT supported by any documentary proof.

  • In each of the example, the allegation is a 'DAP Adun (rep)' takes a cut of between five to 10 percent, while a few more portions would be carved out to individuals or DAP branches. Read here for more in malaysiakini

RONNIE LIU'S PRESS CONFERENCE (24 July 2009)

Read here for more in malaysiakini and here in Malaysia Insider

At the press conference today together with Wong Chuan How, Ronnie Liu (DAP Adun for N47, Pandamaran) denied any wrongdoing, adding that the allegations of corruption were baseless. He claims the official records of state fund disbursements were falsified in order to tarnish him and DAP.

Liu said,
  • The allegations are pure bull . We are not afraid of any investigations. Officers in the Land Office would be able to testify that everything was above board.
  • The complete set of documents is available at the Sepang District Office and the Malaysian Anti-Corruption Commission (MACC) is free to investigate.
  • The approval of funds for the opposition held Sungai Pelek constituency were handled by him and records of disbursement had been posted online in his blog since last year.
  • Everything is above board and approved by the Land and Mineral Office

  • Wong Chuan How was NOT a contractor but acted as the liaison between the Land and Mineral Office, which disburses the funds, and the recipients. Wong, 50, is a former businessman and currently sits on the Sepang Municipal Council.

  • The two files (which he presented at the press conference) recorded ALL the disbursement of state funds and certain information in the documents posted by the blog author were falsified. Such as:
  1. The alleged disbursement of RM1,000 for a pesta ang pow (Chinese new year function) in September 2008. Chinese new year celebrations are usually celebrated between January and March each year.
  2. The alleged disbursement of RM1,000 to buy hampers for Seberang Perai village chiefs in November 2008. This was impossible as the district officer would not approve of distributing funds OUTSIDE the constituency, let alone another state.
  • I don't know what is the link between Teoh and me. He never worked for me at all!”

Saya bersyukur menjadi seorang Muslim.

The demarcation line between the Malay Muslims and bangsa ISA is getting clearer and more vicious. The Malays and the Muslim, I was told, are more than ready to face bangsa ISA.

There's no two ways about it.

ISA menahan tanpa bicara. Islam mengharamkan penahanan tanpa bicara.

PM Najib's Sinister Plan to Cover Up the Death of Teoh Beng Hock and Protect the MACC

Former Law Minister Datuk Zaid Ibrahim said the decision by the Cabinet to split the investigations on the death of Teoh Beng Hock while in the custody of MACC , between a magistrate's court and a royal commission of inquiry is another “ploy for cover-ups.”

Quote

"... Sickening. The rakyat will NOT get the truth from THIS government.

Why split? The magistrate will determine the cause of death?
Then who determines the culprits? The POLICE.

(And) the Royal Commission is for determining procedures adopted by MACC? Don't they have a manual?

There will be cover-ups and more cover-ups...."

-Datuk Zaid Ibrahim
Former Law Minister

".... Najib thinks that an RCI looking ONLY into MACC's methodology would be sufficient to douse the anger of Malaysians and restore confidence in his leadership.

What does he take Malaysians for? A bunch of dimwits?

Instead of probing his death, the Commission is asked to look into the interrogation methods of the MACC. The absurdity of this move is akin to a school boy caned to death in a school, and the public inquiry is over the disciplinary procedure of the school, not over how and why the boy met his death.

WHY didn't the POLICE seal the office, seize all relevant documents including notes of interrogation, dust for finger prints particularly those at the window on the very first day (July 16), as death by foul means clearly could not be excluded.

There are questions that suggest criminal liability of MACC officers over Teoh's death to the backdrop of a political conspiracy aimed at sabotaging the Selangor Pakatan state government.

It is as clear as day light that the MACC exists NOT to wipe out corruption, but to wipe out Pakatan Rakyat - not only in Selangor but all over the country.

Let us resolve that the FASCIST powers (of UMNO/BN) be not tolerated henceforth...."
- Kim Quek

Datuk Zaid Ibrahim said the Cabinet is short-sighted in handling the death of a DAP political aide.

He noted that a royal commission would be UNLIKELY to solve the deep-seated problems affecting the public's trust in government institutions.

Zaid said,
“Why split? The magistrate will determine the cause of death? Which is a fall from a high place. Then the royal commission is for determining procedures adopted by MACC? Don't they have a manual? Then who determines the culprits? The police.

So we're back to square one. Sickening. The rakyat will not get the truth from this government.

Did you get anything from the royal commission on Lingam video? None.

What's the difference now?

There will be cover-ups and more cover-ups."
He pointed to the failure of the Attorney-General to follow up with concrete action after the highly-publicised royal commission of inquiry's hefty report on Datuk V.K. Lingam disclosed incriminating evidence of hanky-panky between the prominent lawyer and several influential VIPs, including judges, politicians and business tycoons.

Zaid, who is away in London, said Prime Minister Datuk Seri Najib Razak must answer to the public on the government's lack of determination to see justice done on the wrong-doers, all the way through to the end.

The Royal Commission of Deception

Read here for more in malaysiakini

Excerpts:

Prime Minister Najib Razak has finally announced the setting up of a royal commission of inquiry (RCI).... But what a let down, and what a deception!

Instead of probing Teoh Beng Hock's death, the Commission is asked to look into the interrogation methods of the MACC.

The absurdity of this move is akin to a school boy caned to death in a school, and the public inquiry is over the disciplinary procedure of the school, not over how and why the boy met his death.

Najib thinks that an RCI looking into MACC's methodology would be sufficient to douse the anger and restore confidence in his leadership.

What does he take Malaysians for? A bunch of dimwits?

Concurrent with this RCI is an inquest where a magistrate would look into the cause of death. But any one familiar with legal practice can tell you that comparing an inquest to a RCI is like a child vs an adult.
  • A Royal Commission of Inquiry is commissioned by the King, and it is usually made up of senior members of society with distinguished records of competence and integrity, and having wide power to summon for witnesses and evidence, and reporting to the King;

  • An INQUEST is manned by a JUNIOR legal officer whose source of evidence is limited to feedings from the authorities (mainly police) with NO power to call for witnesses and other evidence, and forwarding the findings to the attorney general.
Since an RCI is going to be set up in response to public demand to uncover the truth pertaining to Teoh's death, why create another junior body to take away the principal task - finding out how and why Teoh died - leaving RCI as a side show?

Besides, without allowing RCI to probe into the death, how could it fathom what has gone wrong with the operations of MACC's? In fact these two tasks are integral and inseparable.

Only when the full circumstances surrounding the death are ascertained, can the defects of the system be defined and recommendations made.

This is plain common sense, and I can't imagine a man of Najib's intelligence being unable to comprehend this. That leaves us with no alternative but to conclude that the UMNO leadership is playing a game of hide and seek with the public as far this tragedy is concerned.

THE SUSPICIOUS ACTIONS OF THE MALAYSIAN POLICE

The police investigations in particular have been shockingly questionable and unprofessional.
  1. Why didn't the police seal the office, seize all relevant documents including notes of interrogation, dust for finger prints particularly those at the window on the very first day (July 16), as death by foul means clearly could not be excluded.

  2. Despite evidence of Teoh's fall from the building while under custody, why did Selangor police chief Khalid Abu Bakar say that he did not suspect foul play and classified the case as "sudden death" - even before autopsy was performed? Didn't this presumption betray patronization of a fellow law-enforcing agency?

  3. Why did the police forensics personnel visit the crime scene only on Day FOUR (July 19) to take evidence, removing articles such as documents, CCTV records, window latch etc, knowing that vital clues could have been erased, tampered with or removed in the intervening threee days? Didn't this reflect a lack of seriousness?

  4. Why did the police DENY repeatedly to assemblyman Ronnie Liu (left) until day FOUR that it possessed Teoh's hand phone, when in fact it had been in their hands since day one? For what reason or reasons were the police secretly keeping the phone for so many days?

  5. The body was discovered at 1:30pm and Teoh's boss assemblyman Ean Yong Hian Wah arrived at the MACC office at 5pm asking to see Teoh, but the personnel therein including Selangor police chief Khalid Abu Bakar did not entertain him for more than an hour.

  6. Why keep the news from Ean Yong for so long? Why wasn't Teoh's family informed in the first instance ? Was this long duration of silence a needed interval to complete certain preparatory work before the bad news was announced to the world? Shouldn't such improper conduct give rise to suspicious imputations?

  7. The autopsy was completed on day TWO (July 17), why were the police still keeping the findings under the lid?

THE CRIMINAL LIABILITY OF MACC OFFICERS

There are questions that suggest criminal liability of MACC Officers over Teoh's death to the backdrop of a political conspiracy aimed at sabotaging the Selangor Pakatan state government with corruption prosecutions.
  1. Why did director of investigations Shukri Abdul lie that Teoh was released at 3:4am and that he had no idea how Teoh's body landed on the fifth floor balcony, when in fact Teoh was never released and fell off a window in the office? Was there a necessity to lie if there was no criminal liability on the part of MACC?

  2. Why was Teoh tortured in a marathon interrogation that stretched into the early hours of morning when he was not a criminal suspect but only a witness assisting in an investigation over a hearsay allegation of misappropriation of a paltry RM 2,400 by his boss Ean Yong?

  3. Ean Yong was among a group of seven Pakatan assemblymen selected for investigation for unspecified suspicion of miss-using their annual allocations of half a million ringgit each.

  4. In contrast, Pakatan complaints against BN assemblymen for having dubiously spent their entire annual allocations within the short period of two months shortly before the last election in March 8, 08 have been met with silence for more than a year.

  5. Why have Pakatan leaders been systematically hounded over dubious petty allegations whilethe MACC routinely plays deaf and dumb over multi-million and even multi-billion scandals of corruption and abuse of power by Barisan Nasional leaders? Why the silence over the RM 12.5 billion PKFZ scandal despite having received numerous complaints from Pakatan since 2004? Why no notice was taken over the recently exposed mansion of former Selangor Menteri Besar Khir Toyo reputedly worth RM24 million which was well beyond his accumulated official income?

  6. Why NO action against Khir for the numerous reports of corruption and abuse of power uncovered by the Pakatan state government since the last election?
It is as clear as day light that the MACC exists not to wipe out corruption, but to wipe out Pakatan Rakyat - not only in Selangor but all over the country.

It is in the realization of this despicable role played by the MACC, that the tragic death of an upright and dedicated young man - who was due to get married on the day his life was so cruelly snuffed out - has caused the nation's tolerance to reach breaking point.

Let us resolve that the fascist powers be not tolerated henceforth. Let us all stand up for justice for Teoh Beng Hock.

Suruhanjaya Diraja perlu peranan lebih besar

by

Irwan Muhammad Zain

PM Najib is NOT Serious in Helping Malaysians to Find the Truth on Teoh Boon Hock's Death While in MACC's Custody

A HALF-BAKED
ROYAL COMMISSION OF INQUIRY

PM Najib is NOT Serious
in Getting the Truth of Teoh Beng Hock's Death

Read here and here and here

The government has agreed to form a royal commission of inquiry (RCI) to look into the investigative method used by the MACC.

The RCI's scope of work will NOT cover the sudden death of Teoh Beng Hock.

Prime Minister Najib announced yesterday that the CAUSE of the death of Teoh Beng Hock will be determined by an INQUEST, and NOT by the Royal Commission.Read here for more in "Straight Talk" Blog

The Royal Commission is ONLY going to look at the interrogation methods of the MACC.

You don’t need a Royal Commission for that.

If you want to know, just ask people who have been grilled by the MACC. They can tell you what it’s like.

Royal Commission for what?

The last two we had achieved little in the way of making things better and punishing the guilty.

And an inquest for what?

We all know what the cause of death was. An autopsy by doctors from Tengku Ampuan Rahimah Hospital and University Malaya Medical Centre showed that Teoh died from the impact of falling from a great height. It also showed he did not have any injuries before the fall.

How he got there is another matter.

If after completing investigations, the police cannot, do not, or will not reveal who or what caused Teoh to fall, what makes you think an inquest will have a more revelatory effect? Read here for more in "The Aisehman Blog"

Opposition leader Anwar Ibrahim, has asked that the terms of reference of the royal commission should also cover the CAUSE of Teoh Beng Hock's death.

Anwar said:
"Looking at the terms of reference of the royal commission as outlined by the Cabinet, it is to only study the interrogation tactics employed by the Malaysian Anti Corruption Commission (MACC), and not Teoh's cause of death.

The formation of the royal commission (as that proposed by the Cabinet) would not stop the erosion of public confidence in various enforcement and justice institutions or answer the riddles surrounding Teoh's death.

I am of the view that the commission should focus on the CAUSE of Teoh's death.

It is not proper for the cause of death to be determined through an inquest by appointing a magistrate while the investigations are being conducted by the Home Ministry and the police.

The government should realise that the public want a Royal Commission was because they no longer believe in the integrity and the independence of the police and the Home Ministry.

I am certain the public do not want to see this royal commission to end like the VK Lingam saga or the former IGP's attack on me where no proper follow-up action was been taken."
If the recommendations were ignored, like the RCI of Police Force, we will still go back to a square box.

If this RCI is going to end up with the other two, then expect no justice to be served on the family, friends and loved ones of Teoh. Read here for more

The Pakatan Rakyat leadership issued a statement saying the government was wrong in limiting the terms of reference of the royal commission of inquiry to look only into the MACC's investigative procedures.

Pakatan Rakyat believed that the royal commission MUST also look into the CAUSE of Teoh's death.

The joint statement by the Pakatan Rakyat leadership said:
"This makes a mockery of the public outcry for justice, truth and accountability,

Whilst it is appropriate that the royal commission investigate the procedures of investigation of the MACC, the key question of how Teoh died must also be investigated and answered by them.

That question cannot be separated from the more general issue of how the MACC conducts investigations,

In an inquest, police will give the evidence that it has gathered and the DPP assisting the coroner in the inquest would direct questions. There are limited roles played by other parties and this results in numerous inquests ending up without determining the cause of death" .

Furthermore, the public has questioned the integrity of the police, judiciary and the prosecution in the past. Hence, we strongly feel that an INQUEST IS INSUFFICIENT.

Expanding the Terms of Reference of the Royal Commission to determine the cause of death of Teoh Boon Hock would be seen to be independent."
The statement was signed by PKR vice-president R Sivarasa, PAS council member Dzulkefly Ahmad and Selangor DAP secretary Lau Weng San. Also present was PAS treasurer and Kuala Krai MP Dr Hatta Ramli.

The Pakatan Rakyat said there were many questions that needed urgent answers to the circumstances leading to the death of political aide Teoh Beng Hock while being questioned by the Malaysia Anti-Corruption Commission last week.

They said that some of the questions that needed to be answered were:
  1. Why was Teoh's case allegedly involving an amount less than RM2,500 is pursued with such aggression and urgency?

  2. Why was Teoh and another so-called "witness" kept overnight and interrogated with such oppression?

  3. Why was Teoh's hand phone in the custody of the MACC when the MACC insisted that he was only a witness; why did the MACC initially deny they took his handphone?

  4. Why would Teoh spend the night at the MACC's office if he was free to go especially since he was scheduled to be married the next morning;

  5. Why would Teoh commit suicide (as alleged by MACC and others) in these circumstances, when he is about to get married, with his fiancé expecting their child, and with no sign or history of depression or mental illness.

Terbunuhnya Teoh: Suruhanjayalah! Bukan inkues

Read here for more in Penarik Beca blog

Teoh death: No to inquest, yes to royal commission

A Royal Commission of Inquiry, and not an inquest, should look into the death of Teoh Beng Hock.

This was the consensus of the legal fraternity and the Human Rights Commission of Malaysia (Suhakam) in response to a statement by Federal CID director Datuk Seri Mohd Bakri Zinin that Teoh's case could end up in a coroner's court as an inquest would usually be conducted by the court for cases of "sudden death".

Teoh's case has been classified as such, and this is normally investigated by an inquest, which is essentially judicial investigations carried out by magistrates upon the request of the public prosecutor.

Bar Council president Ragunath Kesavan said an inquest would not be able to answer all the questions raised in the last one week on Teoh's death.

"In this case, there are more answers needed than just the cause of his death. An inquest would be insufficient to address these questions."

Ragunath said in contrast to the limitations of an inquest, a Royal Commission would cover a wider scope, including finding out the circumstances surrounding his death, regulations, protocols and standard operating procedures of the MACC.

"MACC is a very important public institution and there is a negative impact on the commission if they are unable to answer, for example, why he was not accompanied by a lawyer, and the need to question him for a long time when he was a witness assisting in the MACC's investigations," he said.

Ragunath said it was pertinent that the a Royal Commission of Inquiry presides over the matter as it was also in the position to clear the MACC's name.

Criminal lawyer Datuk Baljit Singh Sidhu also supported the call for a royal commission to oversee the inquiry. "This is a situation where the MACC, given tremendous powers to run investigations to the extent that they can't be sued in a civil court, also carries the responsibility of a highly-accountable body. If its officers had not acted in a wrongful manner, then it is only right that a royal commission presides over investigations. It is hugely important that the public does not lose faith in the MACC.

"A royal commission is more open and transparent as it is not rigidly governed by the rules of the criminal procedures. In an inquest, the coroner who makes the decision is normally a magistrate but in a royal commission, senior members with expertise covering every aspect of the case would be able to conduct a more comprehensive inquiry."

Suhakam commissioner Datuk N. Siva Subramaniam said a Royal Commission of Inquiry would, among others, be able to dwell into matters like competency and manuals used by MACC officers to question their witnesses.

"The MACC has no choice but to clear its image and there is no better way than this. The royal commission panel will have to get the consent of the Yang Di-Pertuan Agong and therefore it will investigate the matter as an independent party."

Arresting the Slide in Our Public Institutions - Part II

by

Excerpts: Read here for more

In the wake of the MACC scandal involving the tragic death of a young political assistant to the DAP party, it is imperative that Malaysian society re-asserts its presence in the public domain by demanding an enquiry into what really happened at the premises of the MACC office.

But more than the details of the interrogation process itself, the protests over the death of the young PA at the MACC office has to start from the simple premise of who runs MACC and whose agenda was it serving?

Lest it be forgotten, MACC stands for the Malaysian Anti-Corruption Commission. The very name itself spells its purpose and mandate and should remind all of us - MACC officers included - that they are PUBLIC SERVANTS who are meant to serve the interests of the Malaysian PUBLIC, of whatever political background or affiliation.

It beggars belief that among those accused is a State Assemblywoman who is said to have given money to a health centre in her own constituency, while other more notable cases that includes a former senior (UMNO) politician who has built for himself a Bali-styled mansion fit for a King (or perhaps even surpassing the palaces of the Kings) are NOT called in for questioning.

It is this blatant and shameless selectivity of the MACC investigation procedure that adds to the growing cynicism of the Malaysian public, and raises questions about the objectivity and credibility of the institution. We have seen many other cases of selective persecution in so many other failed and failing states all over Asia and Africa, and in all of these cases the rot begins when the institutions of governance fail in their stated goal of serving the public and end up serving the interests of those in power.

SPRM= Suruhanjaya Pembunuh Rakyat Malaysia

MACC’s reputation in the long run will depend on HOW the enquiry into the death on its premises will be carried out, and whether the body can persuade the Malaysian public that its enquiries into the alleged wrongdoings of lawmakers in Selangor are not motivated by other political agendas that may serve other party-political interests as well.

In the meantime, as the Malaysian public clamors for reforms in key institutions of state such as the police and the educational system, it is imperative that WE - the Malaysian public - play our role as the real power-holders and stakeholders in the system by demanding that these institutions perform their basic task, which is to serve the Malaysian PUBLIC in the FIRST place.

Anything LESS than that would be to concede to a neo-feudal political culture where the citizenry have no role to play (save voting once every few years) and where politicians and public servants behave like rulers immune to the law.

That is not development, the word for it is DEGENERATION.

"....I am honoured that Datuk Zaid Ibrahim invites me to join PKR, and to dissociate myself from a party (UMNO) which he now finds FASCIST and RACIST.

I am under no illusions that Umno is bound for destruction on its present course. Neither do I hold unrealistic expectations about the possibility of reform when the rot has gone so deep.

(UMNO) has become CORRUPT, this corruption has weakened it. As it grows weaker it is tempted more and more to fan RACIAL feeling and abuse public institutions to maintain power. This is a death spiral.

Our major public institutions and our political system have degenerated to the point that the public no longer trusts them. A democratic system of government CANNOT function BELOW a certain threshhold of public confidence. The suspicious death of Teoh Beng Hock under the custody of a watchdog body (macc) reporting directly to a prime minister may have pushed us below that threshhold.

We need the rakyat to rise up to claim their institutions, and DEMAND that our public institutions are answerable to them.

We must wake up to our sovereignty as citizens, reclaim the constitution which constitutes us as a nation and guarantees our rights, and demand a comprehensively reformed government to restore public confidence.

We must do this BEFORE it is too late...". Read here for more

About 60 members of the Ampang UMNO division today gathered in the city centre in support of MACC and the POLICE.

And t
he UMNO gathering did NOT have a police permit. NO ONE from the UMNO illegal gathering was arrested.

A similar gathering will take place later tonight at the Pandan Umno division office.

The protest was led by division chief Ismail Kijo at a car park next to the Ampang Point shopping complex in Jalan Ampang, Kuala Lumpur. Also present were members from the Umno divisions in Pandan and Gombak as well as several members of Barisan Nasional component parties of the Ampang division.

One banner read ' Ampang Umno has confidence in police, MACC'.

Ismail WARNED the opposition not to politicise the death of DAP political aide Teoh Beng Hock at the MACC building in Shah Alam last Thursday and divert attention from the matter at hand.

"Don't exploit his death and don't evoke racial sentiments (because of) that," he WARNED , adding that if the opposition persisted, they would RETORT !!!

Police Tried to Absolve MACC Officers from Liability Read here for more

The police wanted to "absolve MACC officers from liability" in the death of Teoh Beng Hock, said a lawyer, after the political aide's family was interrogated by the police at Kajang police station today.

Most of the police questions focused on the possibility that Teoh's death could NOT have been caused by the MACC officers.

Lawyer, Eric Tan Pok Shyong said:
"For example, they asked about Teoh's characters, if he had complained about work before he died, and tried to make a connection with his work and the possibility that he may taken his own life as a result.

They also asked if Teoh was a smoker. I'm guessing the only reason they asked that was make an attempt establish that he may fallen accidently out of the window while smoking.

The family members answered all their questions and denied any possibility of suicide."

Lim said,
"The family members were mindful of the questions posed by the police who wanted to know if Teoh was depressed, suicidal or had financial problems.

The family have denied all this. Teoh was joyful and had no problems at work. Teoh had no financial issues, got along well with everyone and was preparing for his wedding.

He contacted no one immediately before the incident...because the fiancee, being the closest person to Teoh, said that she received no phone calls from him," he said.

The police had asked Teoh's fiancee one 'interesting question', whether he changed his shoes everyday.

They asked if Teoh owned many shoes and what size he wore...the fiancee said that Teoh had several pairs and seldom changed them unless they were damaged, but on that fateful day, he wore a new pair. "
This is in relation to the investigating officer's revelation that Teoh's shoes looked in shreds when his body was found.

Lim said the family welcomed the government's setting up of a royal commission of inquiry today to get to the bottom of Teoh's death. Family members are happy and they hope the inquiry will start soon.

MACC Only Took Files on CHINESE State Assemblymen

Excerpts: Read here for more

The conduct of the Malaysian Anti-Corruption Commission (MACC) in its investigations into alleged misuse of state allocations by Pakatan Rakyat (PR) state lawmakers was again called in to question today.

Selangor executive councillor Teresa Kok, first raised the issue on July 13 when she asked why only Chinese state lawmakers from the Petaling district were being targeted in the MACC probe. The seven state lawmakers were Kok, Hannah Yeoh (Subang), Ean Yong Hian Wah (Sri Kembangan), Dr Cheah Wing Yin (Damansara Utama), Edward Lee (Bukit Gasing), Lau Weng San (Kampung Tuanku) and Elizabeth Wong (Bukit Lanjan).

Teresa Kok said today :
  1. On July 16 a New Straits Times report based on MACC sources indicated that the agency was also investigating five Malay PR lawmakers for alleged falsification of claims. The NST editorialised that this was contrary to claims made by Kok that only Chinese state lawmakers were being investigated.

  2. Her checks with the Petaling district officer revealed that ONLY the FILE of the seven CHINESE lawmakers were taken by a MACC investigating officer, on June 23.

  3. " The truth is NO files from other state assemblymen in the Petaling district, except the seven of us, were taken by the MACC,” adding that she was just stating a fact when she questioned the MACC conduct.
Her exco colleague Ronnie Liu said MACC NEUTRALITY in conducting its investigations is suspect.

To date MACC has NOT hauled up any BN state lawmakers for using their annual allocations amounting to RM500,000 in just two months in the run up to the March 8 general election last year.

Questions About the Death of Mr Teoh Beng Hock....

Mr Teoh Beng Hock’s death marks a watershed in the attitude of the public towards their government. The government has plumbed a new low in loss of credibility. Many people have come up to tell me in anger or despair that they feel their country has gone off the rails. People who previously considered themselves apolitical have been roused into active engagement.

There have been too many deaths under custody. But this death is particularly disturbing because Mr Teoh died after interrogation by a specially commissioned watchdog agency, inaugurated with fanfare last year by the outgoing administration. The very agency set up to combat the abuse of power has become in the public eye a symbol of the abuse of power.

Mr Teoh was a mere witness. He was questioned about the possible misuse of funds by his employer, a state assemblyman, to buy flags for the last Merdeka celebrations. The sum in question was RM2,400. He was questioned for eight hours through the night. He was found dead the following day outside the MACC’s headquarters.

Mr Teoh, 30, would have registered his marriage last weekend. His fiancée is two-months pregnant.

If the Perak debacle reminded us of the importance of the Constitution, the death under suspicious circumstances of Mr Teoh Beng Hock has brought home in a heart-wrenching way how much we need our public institutions to be independent and law-abiding. A shocked public is demanding answers, and rightly so.

Questions about how Mr Teoh died cannot be shut down with the usual warning that it is “liable to confuse the public” because the public is already confused.

We are confused about how an idealistic young man with everything to live for can enter the headquarters of the Malaysian Anti-Corruption Commission as a witness one day and be found dead outside the next.

Questions about the death of Mr Teoh:
  1. Cannot be swept aside with the paternalistic instruction to “leave it to the authorities to investigate,” because the death of Mr Teoh appears to be just the result of “leaving it to the authorities investigate.” It is precisely the independence of the investigating authorities that people are questioning.

  2. Cannot be suppressed with the warning “not to speculate” when the investigating authorities were apparently able to prognosticate, ahead of their own investigations, that foul play was not involved, and some leaders appear to have special knowledge that Mr Teoh jumped to his death of his own accord.

  3. Cannot be evaded with the low tactic of racializing the issue because the death of Mr Teoh touches us all as citizens, brothers and sisters and fathers and mothers. None of us wants to live under a government apparatus that cannot be trusted to be independent and to tell the truth.

  4. Cannot be suppressed with authoritarian prohibitions because they are about the integrity and independence of institutions that belong to the people. Those ministers who talk down to the people may have forgotten who put them into government and pays their wages, and whose questions they were put there to ask. And to answer.
To ask such questions is not to “politicize” the issue but to exercise our ownership of an issue that touches each and every one of us as citizens:
  • Our basic institutions are rotted out, and,
  • We are headed down the path of a failed state.
It is our right and indeed our duty as citizens to keep asking questions when someone dies under circumstances that put the entire government under a shadow.

As we ask these questions let us accept our joint responsibility to push uncompromisingly for an overhaul of the key institutions that have rotted through under exactly the kind of authoritarianism that would prohibit discussion of the circumstances of the death of Mr Teoh Beng Hock.

Excerpts:

Senior Umno leader Tengku Razaleigh Hamzah expressed concern that the recent death of Teoh Beng Hock is a sign that the Malaysian Anti-Corruption Commission (MACC) has gone “rogue”.

Tengku Razaleigh Hamzah said that nothing should be spared in the effort to find out the reason behind the death of the DAP political aide.

He also hit out at the MACC for investigating minor cases while ignoring major examples of graft.

He said that Malaysians no longer feel safe or secure if mere witnesses called in to give evidence to a graft busting agency could be found dead the next day.

He said
"I feel it is very bad for a country like this. We have been independent for 50 years. Must people called up for queries end up in a coffin?

"This is a question of death you know. People want to know. I want to know. How could it happen?

To a witness, who is going to give evidence and he is not even a suspect over the spending of RM2,400.

Some people with millions of dollars, they get away with it and are not called for investigation."
Police are now probing his death and the Cabinet is expected to discuss widespread calls for a Royal Commission of Inquiry into the tragedy.

Tengku Razaleigh said calls for a Royal Commission of Inquiry into Teoh's suspicious death would be of NO USE if the government does NOT follow through on its suggestions.

He said the government had IGNORED the recommendations of PREVIOUS Royal Commissions, such as the one that investigated the V.K. Lingam case of alleged judge fixing and on improving the police force.

He even likened the sidelining of previous royal commissions to
"insulting the King."

The former finance minister also spoke out against the performance of the MACC, pointing out that it has not been as effective as its counterpart in Hong Kong at wiping out the corruption scourge.

He hit out at the commission for allegedly going after potentially minor offences but ignoring the MAJOR ones, saying that the current MACC model needs to be reviewed.

The following is a transcript of TMI's conversation with Ku Li.
TMI: I understand you have some concerns about the recent death of Teoh Beng Hock who was found dead outside the MACC headquarters.

Ku Li: Yes. Why should anybody who is called for assistance into investigations or is held in the custody of the MACC die? There is no reason. I am not saying they are responsible for the death. That is subject to investigation. Can't they look after these people to ensure nothing happens to them? Must it happen like this all the time?

TMI: Do you agree with the calls for a Royal Commission of Inquiry?

Ku Li: That seems to be thinking of a lot of people. That may not necessarily be the best thing to do under the circumstance. You look at the previous royal commissions — on the police, on the Lingam tape. It leads us nowhere and the government doesn't implement all the recommendations even though it was formed in the name of the King. I think it's like insulting the King, not to implement those decisions. People took the trouble to give their views during the hearings. These are people of credible standing who spent their time and energy to get to the bottom of problems. But the government just ignores the recommendations. I hope if they set up a Royal Commission on Mr Teoh's death, they should dig up everything and leave no stone unturned so we can resolve this problem and make people really happy and satisfied but the government must implement what the Royal Commission puts up. It depends on the composition of the commission — who they pick and select. It must be people of unblemished character so that people do not doubt their integrity. This incident has brought about a lot of unhappiness in the country. People don't feel secure, people don't feel safe. People feel they are not protected if a man who is not a suspect, is called to give evidence to the MACC is found dead the next day, I feel it is very bad for a country like this. We have been independent for 50 years. Must people called up for queries end up in a coffin? I don't think that is what the government wants or what the people want. It's not very good for the country.

TMI: What changes do you recommend for the MACC? There have been allegations that MACC is being used as a tool to put down political rivals.

Ku Li: That is always the accusation of the opposition. But let me put it to you this way. It depends on how you read the MACC and how it is implemented. Also there are people running the MACC. Some may employ rough tactics so that they take over control of what they are supposed to do. I thought when the former prime minister wanted to amend the previous law on anti-corruption, he was going to base it purely on the Hong Kong model and I am very attracted to the Hong Kong model if not even to the Australian model.

TMI: Which aspects of the Hong Kong model are you attracted to?

Ku Li: Well, it is more or less the same except that you make it very independent and they were successful in fighting corruption in Hong Kong which was really rife in those days and after the inception of the anti-corruption law in Hong Kong and setting up the machinery to implement those laws, you see that there is minimal or even talk about corruption in Hong Kong. So it has borne fruit. I thought that our government would take that model in toto to implement here and plus whatever other new mechanisms that could be put in place to really stop the rot that is damaging our society. But obviously it is not. And now you see with this death of Mr Teoh, obviously the rogue has taken over the role of controlling all these things which I think is not right.

TMI: Do you think the MACC should be made answerable to Parliament rather than the prime minister's office?

Ku Li: Well it is very difficult for me to say. It must be independent, whether it is Parliament or whatever, I don't know. But we have to relook at the whole model.

TMI: Are you satisfied with the way the investigations have gone so far? So far, only the police have conducted investigations.

Ku Li: I think it is the right thing to do. Now, you are demanding for a Royal Commission and if it is ever set up then they should be neutral, independent and like I said, they should dig up everything and leave no stone unturned. The scope of the investigation is very important. Set up Royal Commission, a lot of hoo-ha and after some time, it dies down, nobody cares and I don't think it should be the case. This is a question of death you know. People want to know. I want to know. How could it happen? To a witness, who is going to give evidence and he is not even a suspect over the spending of RM2,400. Some people with millions of dollars, they get away with it and are not called for investigation.

TMI: Do you share the sense of unhappiness that certain Barisan Nasional personalities are not investigated by MACC but they are investigating these Pakatan Rakyat assemblymen?

Ku Li: That's why I mentioned just now, some people get away with it. Even people accused of amassing funds or fortunes to the tune of billions of dollars. These people are not investigated although accused. But in this instance, it is over RM2,400 for the purchase of flags or buntings.

How Can You Give Justice for Teoh Beng Hock ?

Read here for more on SEVENTH RANGERS (Mechanised) Blog

First you need to get rid of the current UMNO led regime. That means, NO MORE supporting MCA, MIC, Moquito Party PPP and the other many smaller mosquitos.

These are the parties that prop up UMNO and make UMNO audacious, which means recklessly bold in defiance of convention, propriety, law, or the like; insolent and brazen. They give excuses for UMNO to continue to rule under the pretext of being multi racial, taking care of the needs of each individual race, under the banner of the BN.

What they actually perpetuate is the supremacism of one race. Which in turn makes UMNO abuse the rule of law, with the help of government institutions headed by the "Little Napole0ns", without fear of repercussions. They know that the people are impotent. East Malaysians better wake up, before a similar incident happens in your own back yard.

Once that happens you can bring justice for Beng Hock and the many victims who have died due to Police brutality, god knows there are many.

You can bring these paragons of "law enforcement", plus our juciciary and now our infamous MACC to justice. You will be able to throw in a few Ministers in to face the music, maybe starting with the head honco himself.

No matter what screwups the Pakatan Rakyat does, people do not die. These screwups are birthing pains, tolerate them.

You must apply the first principle of war. Do not deviate from that aim, do not add on other aims, for surely you will fail. Hold on to the first aim of getting rid of the UMNO led regime.

Tell Pas to get it's shit organised and stop being shit stirrers with unity talks with a power crazy rabid organisation.

Then after conducting a clean up of the civil service, appointing people with a sense of fair play and justice, only then can justice be served.

Justice for Teoh Beng Hock, Kugan and the many dead.
Which will of course lead to better ruling of this beloved country of ours.

So people stay focussed, wake up.

Ahmad Shauqi bin Ahmad Said , 25, appeared handcuffed in the Adelaide Magistrates Court on a charge of importing CHILD pornography into Australia

Customs officers arrested Ahmad Shauqi at Adelaide International Airport after finding three video files containing child pornography. The videos were titled "Reped (sic) Virgin'', `"10-Year Old'' and "High School Students.''

Ahmad Shauqi's computer was searched after he flew into Adelaide as co-pilot on a Malaysian Airlines flight from Kuala Lumpur.

Magistrate Simon Smart said,
" This material is repugnant and abhorrent - any decent minded person would be so affected by it.

These are not victimless crimes - for every video that depicts such a scene there is a victim. ''

Mr Smart said there would be NO market for such images without people like him.

Magistrate Smart fined Said $5,000 and ordered that his laptop be forfeited to the Crown.

SURAT TERBUKA Kepada BERITA HARIAN

" Jangan Biarkan Beng Hock Mati Sia-sia"

Read here article in CENTER for POLICY INITIATIVES

Tolong jangan mengganggap bahawa para pembaca kamu umpama budak setahun jagung.

Segenap lapisan masyarakat kita inginkan jalan kebenaran.

Itulah sebabnya seluruh Malaysia tersangat berat hati.

Astaghfirullah! Anda sekadar cuba membayangkan bahawa kaum Melayu senantiasa dikepung serta diancam pelbagai musuh. Tunjuk belang, ya?

Jika anda masih lagi kekaburan, biar saya menjernihkan kekalutanmu.

Cukuplah tu. Jangan kerana nila setitik, rosak susu sebelanga!
