Political Cowards in PKR and DAP

PAS president Datuk Seri Abdul Hadi Awang must be congratulated for his clear and honest vision of what his Islamist party stands for.

His speech yesterday is actually good news for many Malaysians: because now it is clear that the so-called puritans HAVE TO BE REJECTED by all who consider PAS a multiracial and multi-religious party.

It is not.

 PAS is an Islamist party that WANTS MALYSIA TO BE AN ISLAMIC STATE , where everyone faces the strict puritanical laws and punishment they hope will deter people from crime and malfeasance.

They once called it an Islamic welfare state but that was JUST A COVER for what Hadi has always maintained – AN ISLAMIC STATE.

Although he says that PAS cannot be used by anyone for their ambitions, Hadi is not above USING THE PAKATAN RAKYAT (PR) FOR HIS AMBITIONS.

That ISN'T Islamic. That's just NAKED AMBITION., And Hadi is a politician who uses Islam to justify his actions and for his own ends.

From his speech, Hadi's PAS belongs on the margins, where it was in 2004 when his hardline and confrontational crashed into the inclusiveness of the Abdullah administration.

Its Terengganu win in 1999 was a blip, more a reaction towards Datuk Seri Anwar Ibrahim's sacking rather than Hadi's clear vision of an Islamic state.

The then Barisan Alternatif (BA) of Keadilan, PAS and DAP did not survive, thanks to Hadi's uncompromising stand on Islamic state.

But the party of conservatives only survived as a mainstream player because out of power, it became part of PR and seemed to accept the principles of coalition politics, once again, in 2008.

But it does appear that hubris and the bodoh sombong culture has infected Hadi's PAS. There is a clear and present danger that Hadi feels he knows what is best for Malaysia.

So much so that it now believes that it can impose its puritanical agenda on PR and the rest of Malaysia. He believes that the rest of his Islamist party and PR must follow his vision or go to hell.

At least he is honest about it. 

AND MALAYSIANS SHOULD BE HONEST ABOUT WHAT THEY FEEL ABOUT HIS VISION OF MALAYSIA.

And Malaysia's message to Hadi and his party men should be simple:  GOOD RIDDANCE.

This time, police arrested Syafiq Abdul Wahid for allegedly having a parody Facebook page called ,"Persatuan Kongsi Gelap Melayu", telling a 
fictional story about a "legendary" Malaysian thug named " Ayah".

Syafiq Abdul Wahid was arrested at his workplace at the Kuala Lumpur International Airport at 3am today and was taken to Serdang police station, said lawyer Michelle Yesudas. Syafiq has been remanded for three days.

Police suspect that he is the administrator for the Facebook page 'Persatuan Kongsi Gelap Melayu', she said when contacted.

According to the Facebook page 'Persatuan Kongsi Gelap Melayu' (The Association of Malay Secret Societies), the page is about a "legendary" Malaysian thug.

It chronicles fictional character 'Ayah' and his gory and often out-of-this-world adventures.

The description on the page reads: "Kisah ayah legend yang sembang kuat… Why so serious? Ni troll laaa bangang…,("This is the story of a legendary godfather who likes to talk big… Why so serious? I’m just trolling, stupid…)."

In the latest post, 'Ayah' recounts how he slapped a loan shark so hard that the outline of his hand is imprinted onto the loan shark's back.

'Ayah' also showed a picture of the loan shark's back as evidence of his prowess. Without saying much, Ayah took out my pistol and shot the smelly loan agreement in the loan shark's hand thrice.

"Ayah blew off the smoke from the gun and folded the gunshot-riddled document into his pocket."

The page has 5,247 'likes' as at 3.30pm today.

 Lawyers, activists, a journalist, an academic have come under the sedition dragnet in the past month.

1, Last week activist Ali Abdul Jalil was slapped with three charges of sedition over Facebook posting he allegedly made.

The Sedition Act is not the only Act used against social media users.

2.  On Sep 9, Facebook user Chow Mun Fai was sentenced to one year’s jail under the Communications and Multimedia Act for insulting Muslims.

3. On Sep 15, Twitter user Victor Wong was charged under the same Act for insulting the inspector-general of police Khalid Abu Bakar.

Prime Minister Najib Abdul Razak in 2012 promised to repeal the Act but now says the government is reviewing whether to amend or replace the it.

He says that this is due to opposing stakeholder views on the repeal.

The Malaysian Bar has passed a motion to organise a peaceful protest against the recent spate of arrests under the Sedition Act.

Proposed by the Bar Council, it was passed after debate during the Bar's extraordinary general meeting at Wisma MCA today.

The motion was triggered by the flurry of arrests under the Act, which saw politicians, activists and a law lecturer being charged for making allegedly seditious remarks.

Bar Council president Christopher Leong (right) said that the motion was passed with an overwhelming vote of 701 to 13.

He also commende the high turnout of 986 members today, he said.

"The Malaysian Bar mandates the Bar Council to immediately organise a peaceful protest in the form of a walk," Leong said.

He said that the logistics of the march, including the date and venue, has not been set but waiting “three to six months” would be "too long".

He also vowed that the walk will not be a “one-off” action in the Bar’s campaign against the Act.

"Our #MansuhAktaHasutan campaign launched on Sept 4 will be a fluid and ongoing campaign," he said.

Moratorium
 
The Bar had also resolved to condemn the Sedition Act and called the government to abide by its pledge to repeal the Act.

It also called on a moratorium on the use of the Act, and for the proposed National Harmony Act not to be a "recast of the Sedition Act".

"The Malaysian Bar is against the use and abuse of the Sedition Act because it is of the view that you cannot stop discussion, debate or criticism as they are all integral parts of the thinking and maturing process," he said.

The Bar had previously led processions against police abuse and the Peaceful Assembly Bill 2011.

The 'Walk for Justice' was held in 2007 where 2,000 lawyers marched 3.5km to the Prime Minister's Department in Putrajaya demanding that a royal commission of inquiry be established to stem the slide in the judiciary.

The march succeeded in compelling then prime minister Abdullah Ahmad Badawi to set up a royal commission of inquiry into the infamous Lingam Tape on appointment of judges.

PAS MUKTAMAR - DEMONISING SESSION

Dalam doanya sepanjang 25 minit itu, Azhari memanjatkan doa agar Mohamad Sabu tidak akan mengeluarkan kenyataan bertentangan dengan presiden, Datuk Seri Abdul Hadi Awang.

Beliau juga berkata Saari dan Hasnul ibarat ejen perosak dalam parti itu, dengan memetik perumpamaan “nila setitik yang merosakkan susu sebelanga”.

“Sekarang kita ada dua nila – satu Cap Hulu Kelang dan satu Cap Morib, mereka nila yang sangat beracun,” katanya dalam doa itu sambil menadah tangan.

Kebanyakan perwakilan yang bersidang di bawah khemah besar di Parit Salleh Ros, Batu Pahat itu dilihat turut menadah tangan.

Malah, ada juga sebilangan para wartawan yang turut menadah tangan.

Doanya yang meleret-leret sehingga lebih 25 minit itu memaksa pengerusi tetap muktamar, Abu Kassim Abdullah mengulangi peringatan agar beliau menamatkan ucapan.

Ia turut menimbulkan kemarahan seorang perwakilan yang meluru ke pentas dan menuntut agar tindakan dikenakan ke atas Azhari.

Beliau meminta pengerusi tetap mengeluarkan ketetapan sama ada tindakan membaca doa yang mengutuk orang lain dalam parti itu boleh dibenarkan dalam persidangan.

“Adakah ini sifat seorang Muslim?,” soalnya sebelum diiring keluar oleh seorang anggota Unit Amal yang turut mematikan mikrofon tersebut.

Prayer Bashing Session at Pro-Pakatan PAS Leaders

 Federal Territories PAS delegate Azhari Ariffin today chose to lead fellow delegates IN PRAYER  instead of giving a speech at the muktamar.
 
The prayer  turned out to be a bashing fest against pro-Pakatan Rakyat leaders including PAS deputy president Mohamad Sabu and state assemblypersons Saari Sungib (Hulu Kelang) and Hasnul Baharuddin (Morib).
 
"We pray that the deputy president will not issue statements that is against the president, that they will understand the meaning of loyalty.
 
"Do not allow a drop of dye to spoil the pot of milk, now we have two dyes - one Cap Hulu Kelang and one Cap Morib - they are very poisonous dyes," he said as he put his hands together in prayer.
 
The prayer went on for over 25 minutes despite the muktamar permanent chairperson Abu Kassim Abdullah repeatedly telling him to cut it short.
 
Towards the end, an angry delegate rushed up to the podium and demanded that Azhari be reprimanded.
 
"We want a ruling from the permanent chairperson. Is it right to use prayer to bash other people in the party? Is this the character of a Muslim? Some non-Muslims here are already questioning is this Islam's teaching,” he exclaimed.
 
However, security, manned by Unit Amal turned off the microphone and ushered him away as Abu Kassim urged calm.
 
Mat Sabu has been getting flak from the ulama faction after he criticised the ulamas for not being relevant with the times. 
 
Saari and Hasnul had, in the Selangor menteri besar saga, defied party orders not to support PKR president Wan Azizah Wan Ismail.

THE SOURCE OF PAS's TREACHERY AGAINST PAKATAN RAKYAT IS THE MAJLIS ULAMA PAS (PAS ULAMA COUNCIL)

Referring to disagreements within the party on the Selangor crisis, he said the party appeared not to have a crisis management plan.
 
"Difference of opinions in PAS was not managed well until it developed into a serious crisis. More unfortunate is when our neighbour has an internal problem, it is our own house that has become a mess," he said in his policy speech at the opening of the 55th PAS Youth muktamar in Kota Tinggi this afternoon.
 
Even though the PAS central committee has decided to back PKR president Dr Wan Azizah Wan Ismail and her deputy Azmin Ali as candidates for Selangor menteri besar, its party president has been at odds with the executive decision making body.
 
THE ROOT PROBLEM IN PAS

PAS president Abdul Hadi Awang, backed by the Syura Council, had overruled the central committee and submitted his own names as candidates for menteri besar to the Selangor palace.

Suhaizan called on the Youth wings within Pakatan Rakyat to "cool down" the situation in Selangor and urged a swift resolution to the problem before it escalates further.
 
He added that polls have shown that Pakatan's support had fallen due to the crisis and a quick resolution was required to prevent it from translating into a loss of votes in the 14th general election.

THE TRUST-DEFICIT IN PAS.... VIRTUALLY NONE LEFT.

.For a party that is so obsessed with the principle of amanah (trust), PAS is in a bizarre position as the Islamist party has lost so much trust in so little time since Election 2013 when the coalition it is a part of won more federal seats.

But the Selangor menteri besar impasse has put the spotlight on the party's 60th muktamar next week where the question is about how much of that lost trust it wants to win back.

As PAS heads into its assembly, this deficit of trust is like a wound that splits its upper echelons all the way down to people who voted them in.

Its leaders cannot trust each other to carry out collective decisions. Its partners in Pakatan Rakyat (PR) cannot trust PAS will support their schemes in the states they rule.

Voters, meanwhile, can’t trust them not to sneak in a controversial, constitution-changing religious law when they’re in power.

Although there is much talk of whether party president Datuk Seri Abdul Hadi Awang will be censured or ousted for his actions in the Selangor MB impasse, observers feel that it will not change the fact that the Islamist party has probably reached a certain ideological limit.

How it behaved in the Kelantan hudud bill issue and the Selangor menteri besar crisis showed that the party is unable to reconcile some of its long-held aims with the demands of working in a modern political coalition.

This muktamar will then be about whether the party has the imagination and courage to transcend those limits.

LEADERSHIP PROBLEM

A senior PAS leader did not want to sugar coat the mood in the party when asked about his thoughts going into the muktamar.

“Its bleak,” said the PAS leader who requested anonymity.

The point of no return was when Hadi decided to ignore his central committee’s decision on who to nominate to replace Tan Sri Abdul Khalid Ibrahim as the Selangor menteri besar.

Political analyst Dr Wong Chin Huat said Hadi’s move undermined one of the key tenets of modern political parties in that they must be predictable and follow certain rules.

Since a president is beholden to a collective decision made by his central committee, he should predictably follow it through.

“PAS under Hadi is so unpredictable, and that is bad. How are you supposed to deal with a party that is unpredictable?” said Wong, of the Penang Institute.

This anger towards Hadi’s conduct is expected to make itself felt in the assembly either through speeches from the floor or a motion of no confidence against him.

PAS information chief Datuk Mahfuz Omar said to date, there has not been any application for a motion against the president.

But according to party sources, there are provisions for an emergency motion of that sort.

Even if Hadi survives such a motion, his credibility and standing would have taken a significant hit.

This would pave the way for someone to challenge him in the party’s next election cycle in 2016. 

But even if Hadi is replaced, there still remains the fact that PAS’s conservatives still have a strong grip on the party.

And it is these ideologues who will continue to push for hudud law and the establishment of an Islamic state.

The pursuit of these aims will continue to make it hard for PAS to work with its more secular allies in PR and more importantly, to convince non-Muslims to vote for it again.

When it pushed for the Kelantan hudud bill after the 2013 elections, said former Johor DAP leader Norman Fernandez, PAS showed how sneaky it was. 

This is since non-Muslims voted for PAS because it pledged to hold on to the PR common manifesto, said Fernandez. Hudud was not part of that manifesto. 

This is the element in PAS that is even trickier to solve than an errant president.

The concept of an Islamic state and the laws that go with it are wired into the party’s identity.

The challenge then, said political analyst Wan Saiful Wan Jan, was how to translate and re-interpret these concepts for a modern, plural Malaysia.

Wan Saiful believes that PAS’s current doctrine of “leadership by ulama” (Muslim scholar) is hampering the party’s ability to find new ways to interpret its Islamist goals.

The doctrine gave birth to PAS’s influential Syura Council, a body of elder Muslim scholars who ensure that the party’s actions conform to what it considers Islamic principles.   

“At the time, the doctrine was good and it really brought the party to where it is now where it is respected in the villages and mosques,” said Wan Saiful of the Institute for Democracy and Economic Affairs. 

Unfortunately, the scholars who influence the party’s direction do not have the intellectual prowess to reinterpret its Islamist agenda for a new era and to take PAS to the next level, said Wan Saiful.

“It was good for producing good village chiefs and elected representatives. But unsuitable for producing a chief minister or a federal level minister”.   

So even if PAS solves the problem of one misbehaving leader at this assembly, it is still saddled with a policy that chooses leaders that may not be suited for governing anywhere else in Malaysia except Kelantan. 

Replacing Hadi could help PAS restore trust among its allies. But reassessing its leadership doctrine could produce a line of leaders who could restore the public’s trust.

The Selangor menteri besar impasse has become quite the circus. And, today, a new act to keep the entire show a lot more ridiculous.

Selangor deputy speaker and PKR Youth chief Nik Nazmi Nik Ahmad revealed today PAS president Datuk Seri Abdul Hadi Awang had raised the possibility of keeping Tan Sri Abdul Khalid Ibrahim as menteri besar during a recent meeting with the youth wings of DAP, PKR, and PAS.

"During the meeting, I asked Hadi about possible solutions to resolve the impasse in Selangor," Nik Nazmi said in a statement today.

"His final answer was to retain Khalid as Selangor menteri besar and he, Hadi, would personally monitor Khalid," he added, noting that proposal would be in conflict with PKR and DAP's choice of Datuk Seri Dr Wan Azizah Wan Ismail taking over as menteri besar.

The conflict with PKR and DAP's stand is one matter. 

BUT THE VERY IDEA  ITSELF IS PREPOSTEROUS. 

1,  , Hadi does NOT  QUALIFY  to monitor Khalid, who has been sacked by PKR for his intransigence.

The PAS president's behaviour in the Selangor MB impasse has exposed him for what he is: someone whose word does not carry much weight.

What more, will Khalid listen to Hadi? 

The incumbent MB has already shown that he listens to NO ONE  in his party, let alone confer with his executive council on serious state matters such as the water restructuring plan or new highways in Selangor.

2,  Hadi's TRACK RECORD  for leading or overseeing state government has been nothing short of disastrous. 

Hadi did a terrible job as the Terengganu MB from 1999 to 2004 that PAS still cannot capture the state despite infighting within Umno. Additionally, his blind support for the late Tan Sri Azizan Abdul Razak led to the FALL OF PAS-LED GOVERNMENT IN KEDAH IN 2013, at a time when Pakatan Rakyat (PR) won more seats in Election 2013.

And, isn't Hadi the PAS leader who mentioned a UNITY GOVERNMENT WITH UMNO IN SELAGOR   if push came to shove to ensure support for Khalid?

SO WHERE IS THIS JOKE THAT HADI CAN MONITOR KHALID AND ENSURE PR KEEPS SELANGOR FOR THE FUTURE? 

Hadi's political acrobatics in the Selangor MB impasse has turned from a side show to the main act. Allowing him his way will just put the joke on PR and the Selangor people.

And, the only ones laughing will be the Barisan Nasional, just the same way they did in Terengganu in 2004 and Kedah in 2008.

THE MAN IS NOT ONLY BECOMING AN EMBARRASSMENT TO PAS MEMBERS AND SUPPORTERS, BUT HE IS TURNING HIMSELF AND THE PARTY INTO A JOKE.   

AND HE WEARS ISLAM ON HIS SLEEVE TO FURTHER EMBARRASS  THE MALAY MUSLIM COMMUNITY WITH HIS BACK-STABBING AT HIS COALITION PARTNERS WHEN IT MATTERS. 

THE PRESIDENT OF A PARTY WHO  SINGLE-HANDEDLY TURNED PAS INTO THE MOST UNTRUSTWORTHY AND UNRELIABLE PARTNER IN POLITICS.

PAS CAN ONLY GET BETTER IF HE IS REMOVED FROM OFFICE. 

THE LONGER HE STAYS AS PRESIDENT, THE FASTER PAS WILL REVERT BACK  INTO AN IRRELEVANT BACKWATERS PARTY ONLY GOOD FOR FAR OFF KELANTAN, NOT EVEN FOR TRENGGANU AND KEDAH.

ADVICE TO PAS LEADERS: FOR PAS TO GO FAR, WALK WITH YOUR COALITION PARTNERS, OTHERWISE WALK ALONE

PAS IS DAMAGED ELECTORALLY IN SELANGOR BECAUSE OF HADI AWANG'S TREACHERY

Photo: PAS central committee Nasrudin Hassan said  Persatuan Ummah Sejahtera Malaysia (PasMa), an organisation set up by the Islamic party's members, of wanting to topple PAS president Abdul Hadi Awang.

Nasrudin claimed that PasMa had in a meeting on Aug 31 at Pustaka Az Zahra, Kota Bharu, discussed about replacing Hadi.

In the week that PAS will hold its annual meet or muktamar, Subky Latiff, the party’s still influential former information chief has sent a clear message that the future of the opposition rests with PAS and DAP.

As for PKR, Subky Latiff said the party cannot be considered as an important ally.

Penning his views in PAS' organ Harakahdaily, he noted that DAP would exist even after Lim Kit Siang and his son Guan Eng.

However, he said the Chinese-based party would be more potent if it has a Malay political teammate to mount a challenge against BN.

"An ally with grassroots is PAS, and PAS too will be here for a long time," he added.

As for PKR, Subky said it remains unclear who would lead the party once Anwar Ibrahim is no longer around.

He also claimed that the majority of Malay backing for Anwar and PKR comes from PAS, and if Anwar is no longer in power, that support base cannot be guaranteed.

"On the other hand, the non-Malays depend on the support from DAP, and DAP’s support for PKR is also because of Anwar.

"But if Anwar himself loses the support of Malays, then what can DAP hope to do with regard to helping him get closer to Putrajaya?" he asked.

Subky pointed out that PAS needs DAP and the latter requires the support of the Islamic party, and the two enjoyed a good working relationship in Perak when Pakatan captured the state.

Commenting on the ongoing Selangor menteri besar crisis, which has strained ties between PAS and PKR, he noted that DAP did not take any steps to ease the tension.

"Now the sultan has called DAP defiant. Whether the decree is correct or otherwise, Umno and DAP's foes are happy.

"Unlike before, PAS is unable to dilute the negative perception towards DAP. Before this, whatever the Malays said about DAP, PAS is the one which diluted it," he added.

Subky said If DAP wants to disassociate itself form the "defiant" tag, then it must decide to calm down PKR so that it would be "softer" with PAS.

"Because of the current political situation, the future of DAP will be better with PAS. It doesn’t matter if DAP doesn't need PAS, but PAS feels that it must be friends with DAP.

"DAP should not discard PKR, but PAS is far more important," he added.

It is also BETTER FOR  PAS to go solo or form unity-governments withUMNO, a goal, as recent as two weeks ago, and dreamed about in the last 10 years or more by the ULAMA faction of PAS.

Former law minister Zaid Ibrahim said  there are NO detailed laws and prohibitions covering the four sacred areas mentioned by Home Minister Ahmad Zahid Hamidi, therefore it would be unfair to punish Malaysians for talking about them.

Despite the sedition crackdown, Zaid did not mince words in claiming that the APARTHEID SYSTEM IN SOUTH AFRICA WAS BETTER THAN THE SITUATION IN MALAYSIAN AS THE LAWS THERE THEN WERE CLEAR.

BAHASA MALAYSIA

Starting with Bahasa Malaysia, Zaid pointed out that no right minded Malaysians are opposed to the national language.

"It probably exists only in the mind of the minister. If the PM speaks in English at his press conference( and he likes to do this ) would he be insulting the national language?

"Must a Malaysian speak in Bahasa Malaysia at least once a day to be regarded as 'not opposing' the language? We should have laws passed to make it clear what constitutes an offence.

"If we don't, then Umno would always be able to say so-and-so are not loyal to the language or are opposed it. 

"In other words, things would be even worse than what it was like under apartheid because the people would not know what the offending act is. It's all up to Umno," he added.

THE MALAY RULERS

On the issue of royalty, Zaid asked when does one insult a ruler, and called for it to be put in writing as well.

"If a Malay ruler decides to have executive powers in the administration of the country and that is permitted by Umno, then say so in our laws so that the people understand it is an offence to oppose it.

"Pass a clear law that prohibits even commenting on the wishes of a ruler. That was the situation with the Chinese emperor in the Middle Kingdom.

"At least then we would not be duped into thinking that we have a right to ask questions and then face criminal charges for that. We cannot pretend to be a normal democracy when we are actually semi-apartheid in substance," he added.

ISLAM 

Terming Islam as the "big issue", the former minister also wondered what amounted to insulting and challenging the religion.

"For now, everything the authorities do cannot be questioned, for this might be construed as insulting Islam. Help the people by spelling out the issue or circumstances clearly.

"For example, Rosli Dahlan, a friend and lawyer, is facing disciplinary action for defending another Muslim, Kassim Ahmad, in the Syariah Court," he added.

MALAY's SPECIAL POSITION

Touching on the fourth sacred area of Malay special rights, Zaid noted that during apartheid,  questioning the whites for their discriminatory policies was an offence.

"How different is this from what the home minister said in his recent speech? For now, no one knows what constitutes the Malay rights that he was talking about.

"Article 153 is about 'privileges' so I am not sure what Malay 'rights' are. If I say we should send more Malays to vocational and semi-professional courses, and therefore fewer of them to universities, the minister will probably think I am anti-Malay.

"(Former premier) Dr Mahathir Mohamad recently said Malays are lazy or lacking in integrity. Is this an offence? We should list out all the situations where we are prohibited from talking about the Malays, the way the Afrikaaners did to the blacks," he added.

MALAYSIAN LAWS OR UMNO's LAWS

In the absence of clear laws, Zaid noted that Umno would become the sole authority to define what is and isn't an offence .

"It is already clear that if you make Umno angry or feel insulted, it’s an offence. This is pernicious and unfair , and far worse than the laws that were in place during the apartheid era, surely," he added.

PAS : PARTI POLITIK TAK MASUK AKAL

Photo: Federal Territories PAS has joined  Terengganu PAS in banning its members from joining PAS-linked NGO Perpaduan Ummah Sejahtera Malaysia (PasMa).

Federal Territories PAS secretary Khairul Anuar Abdul Manap stipulated that the banned activities include being “a member, founding the NGO, attending PasMa events or assisting in any PasMa programmes of any sort.”

Khairul Anuar Abdul Manap  said 

“If any Federal Territories PAS members are found doing so, they will be considered TRAITORS  to PAS,” he said in a statement.

A similar statement was issued by Terengganu PAS on Sunday.

The statement comes after PAS vice-president Tuan Ibrahim Tuan Man said that the Islamic party members are NOT  allowed to join PasMa.

HRH Raja Nazrin one day gave a talk in Singapore. 

One Singaporean attendee asked him two questions. 

Doctor Nazrin ( he holds a PhD from Harvard) – (1) what is the future of the monarchy in Malaysia and (2) how have they played the role of constitutional monarchs in Malaysia.

Dr Nazrin as he was referred to then, answered: "Since you asked 2 questions, I shall answer the second one first. The position of the Malay rulers as constitutional monarchs is well laid out in the Malaysian constitution. 

Unfortunately there are some among the monarchs who behaved like absolute rulers. 

From there I can answer the first question. The future of the monarchy in Malaysia depends on the conduct and performance of the rulers. "

He then continued; 
"I remember as a kid, I heard the same question answered by our venerable Tunku Abdu Rahman himself a scion of the Kedah Royal House. 

"Tunku said the same thing- the future of the monarchy depends on their conduct. Otherwise I am afraid we will have Raja Kelawar and Raja lekok eventually. 

Otherwise we will have only the King of Hearts and King of Spades. "

I hope our Malay rulers heed the voice of the majority who don’t have the courage to say things openly. 

Maybe they don’t like to hear this- but not few rejected the idea that their destiny depend on the Malay rulers.

Our Kings are the fountainhead of Justice. Our kings have sworn to protect us, not protect UMNO leaders or UMNO. 

Do not allow the government of imperial Najib use the sedition act to subjugate the people. In this internet age no one can be silenced.

The feudal minded among the Malays should accept this. Ours is a constitutional monarch. 

No one is asking for the abolition of the monarchy. When we created special court for them, we acknowledge both their shortcomings and exalted stature and that is why we created special courts for them.

 I don’t have to lecture these people on the meaning of the concept of constitutional monarch.

Those of us who believe firmly in limited monarchy are not at all intimidated by the congregation of people in Selangor pompously proclaiming their undying loyalty to the king. 

There is their business and their own funeral. They want to be absolute royalist let them be. 

The rest of us are contented with just being constitutional monarchy but loyal nevertheless.

We won’t hold anything against you for being zombied out and believing that non-compliance with a royal decree means durhaka. 

The concept of durhaka has no meaning in law- it is NOT  a crime. 

It had meaning only under the regime of absolute monarchs during whose time, people of similar line of thinking like the ones congregating to proclaim their undying loyalty, ingratiated themselves to absolute rulers to suppress the toiling masses. THOSE DAYS ARE GONE MY FRIEND.

The SELANGOR PALACE said a state assemblyperson's majority support in the House is NOT  the sole consideration for appointing the menteri besar.

Therefore, the ruler might even choose a state rep from Pakatan Rakyat who is not on the lists of potential candidates submitted to the palace.

"As the power to appoint the menteri besar is the sultan's prerogative, therefore his highness will look at the names of other state assemblypersons in Pakatan who to the sultan's mind enjoys majority support in the state assembly," said the ruler's private secretary Mohamad Munir Bani in a statement today.

He said since majority support is not the sole criteria, the palace required more than two names from the respective parties in Pakatan as per convention.

Constitutional expert Abdul Aziz Bari has reiterated that the sole qualification for a menteri besar is whether he or she has majority support in the state assembly.

"Even PERSONAL PREFERENCES OF THE RULER HAS NO PLACE" he added in a statement.

“The only qualification for an MB - or PM or CM - is the majority. Gender, academic qualification, and even personal preference of the ruler, has no place,” he elaborated.

Abdul Aziz said that even the condition that the MB must be “Malay and Islam” can be “set aside” in favour of a majority.

Abdul Aziz was responding to a statement from the Selangor palace, which stated that the sultan might even choose a state rep not on the lists of potential candidates submitted by Pakatan Rakyat parties.

The expert questioned why "law and practice" are "different" when it comes to Umno and Pakatan

In a statement, Abdul Aziz said the same palace had, in 1997, accepted Abu Hassan Omar as the MB for the state even though he was a federal minister and a by-election was called specifically for Abu Hassan to be made as MB.

"The law is the same and should be applied without discrimination," he said.

"The way the palace dealt with the matter so far has made the law uncertain and this is not good," he added.

He also reminded that gender discrimination has been “outlawed” under Article 8 of the federal constitution.

"The notion of discretion must be understood in the parliamentary democracy framework," he added.

"We are dealing with a monarchy within a parliamentary democracy framework," he said.

Before we answer the above question, perhaps we should ask ourselves: 

WHO SHOULD RULE THE COUNTRY?

1. THE MONARCH

or

2.  THE PEOPLE ?

I think the answer should be pretty obvious.  

Ever since independence, we have been running elections one after another, during which we elect a ruling coalition to rule the country.

Since it is the people who have decided who they want to rule the country, so the people are actually the real boss, and the ruling party is only an agent selected by the people to fulfil their aspirations.

And the MONARCH's ROLE IS LARGELY CEREMONIAL, with certain privileges and discretions as prescribed in the constitution, as peculiar to Malaysia, under the ambit of the Westminister style of constitutional monarchy.

Among such discretions is the monarch’s power to appoint the prime minister. 

Our Federal Constitution – Article 43(2)(a) read in conjunction with Article 40@)(a) – and which the state constitutions have mirrored, stipulate that the Yang di-Pertuan Agong has the discretion to appoint the prime minister FROM:

  “ A MEMBER OF THE HOUSE OF REPRESENTATIVES WHO IN HIS JUDGEMENT IS LIKELY TO COMMAND THE COMMAND OF THE CONFIDENCE OF THE MAJORITY OF THE MEMBERS OF THAT HOUSE".

THE MONARCH's DISCRETION:WHAT IT MEANS

It is in the interpretation of the word “discretion”, fromm which controversies have arisen.

The Selangor Sultan’s press secretary Muhammad Munir Bani, when he said that the sultan had ordered each of the component parties of Pakatan Rakyat to submit more than two nominees for the MB post, claimed that the sultan has “absolute discretion” in appointing as the new menteri besar a person who he feels enjoys majority support in the state assembly.

This implies that the sultan can appoint whom he likes, as long as he feels that the candidate has majority support in the assembly.

However, most constitutional legal minds hold that the sultan’s discretion is LIMITED to its exercise within the context of ascertaining whether the candidate can command majority  support in the assembly.

In other words, when the ruling coalition has nominated a candidate clearly supported by the majority, the sultan has no more discretion to appoint someone else.

The latter view must be correct, as we must appreciate that the quality and suitability of the leader to head the government is of utmost importance to, not only the ruling party, but also to the nation, particularly to the electorate who have elected the ruling party.

For that reason, it is always the prerogative of the ruling party to decide who it wants to head the government. In fact, the right of the ruling party to choose its head of government, just as its right to rule, is part and parcel of the democratic system that we have adopted.

This has been the practice in Malaysia since independence, and it is also the practice among parliamentary democracies all over the world, whether they are headed by constitutional monarchs or presidents.

MISINTERPRETATION OF " DISCRETION" WILL CREATE CHAOS... WE CANNOT AFFORD THAT.

Imagine the havoc that will ensue if the sultan’s decree is carried out to the letter, resulting in a potential nine or more nominees, and the sultan choses a low quality candidate in preference to Pakatan’s top choice.

In addition to the ill-qualified menteri besar possibly running the government to the ground, such an appointment may create serious intra-party and inter-party frictions in Pakatan, thus ruining the coalition as well bringing disaster to the people of Selangor.

Wouldn’t that be a gross injustice to the ruling coalition, and a betrayal of the electorate of Selangor?

Not by the wildest of imagination, could it have been the intention of the founders of this nation, and the framers of the constitution, to create a constitution with such huge loophole as to plunge the country into chaos?

Above all, the sultan’s decree, as conveyed by his press secretary Munir Bani, could not pass the test of rudimentary logic.

Surely, there must be one candidate that enjoys the highest support in Pakatan, with the others ranking relatively low in its esteem.

So, what is the logic of asking for relatively low-ranking candidates, knowing full well that if any of these are appointed, he or she will likely be rejected by the state assembly, in which event, the menteri besar appointment process will have to be re-run? Wouldn’t it be simple, common sense for the sultan to appoint someone nominated by the ruling coalition?

    We are in troubling times. 

    After the 12th general election (GE12) in 2008, Malaysians felt that at long last, the country managed to create a new alternative to the corrupt UMNO Baru-BN coalition. 

    That euphoria, however, has proven to be short-lived. And now we are back to square one.

    PAKATAN RAKYAT IS A LETDOWN

    The formation of the three political parties–DAP-PKR-PAS- with very different and conflicting goals into a grouping that contested GE12 received tremendous support from the people. 

    Things looked very bright for the future well-being of the country. At long last, they felt that the corrupt and the racists would be ousted.

    It shook the very core of the UMNO Baru-BN coalition. The UMNO Baru-BN government tried to counter its fear of being pushed out of office by persecuting and prosecuting opposition leaders through the use of the Sedition Act and politically motivated charges .

    Now, UMNO Baru-BN has been taken by surprise at what happened in Selangor. 

    The much touted and admired Pakatan Rakyat is moving towards self- immolation. 

    The culprit in this suicidal drama was PKR, a most indisciplined party led by Anwar. 

    To all intents and purposes Pakatan is dead. 

    PAS SHOULD BE LEFT OUT IN FUTURE COOPERATION

    A new beginning has to be initiated and what had happened should be used as guideline for any future cooperation. 

    PAS is most suspect in any alternative. It has many conflicting factions, and each is trying to exert its influence in any agenda that party undertakes. 

    PAS, therefore, should be LEFT OUT until a dominant and more grounded group from among them comes into power.

    RELIGION IN POLITICS  should be avoided as this can bring about disunity and misunderstanding in any attempt to achieve national progress. 

    Religion and the state CANNOT  go hand in hand especially in a multi-religious, multi-ethnic and multi- cultural country like Malaysia.

    There is now a need for the coming together of all progressive forces in Malaysia to combat the current corrupt coalition of  the self-centred and power crazy individuals. 

    DAP - THE PIVOT FOR PROGRESSIVE FORCES

    The pivot for the creation of this will have to be the DAP. 

    It is the only stable and most experienced political party in the country. 

    It managed to weather all challenges and threats posed by the UMNO Baru-BN government.

    It is corrupt free and has the ability to administer the Penang state government with efficiency and has created a progressive atmosphere.

    UMNO-BN SHOULD BE VOTED OUT OF POWER

    The next general election will be very important for the future of the country. 

    If UMNO Baru-BN is not voted out of power, Malaysia’s future is anything but bleak. 

    UMNO Baru has been playing racist and religious politics to rally Malay Muslims and maintain power. This has resulted in the formation of groups like PERKASA and ISMA. 

    The tacit support of UMNO Baru for these two disruptive groups will only encourage more of such elements to surface and create racial and religious chaos.

    The result will be the further loss of intellectual capital. Already, the country has lost a good number of talented people and the brain drain will continue to the detriment of the country. 

    Talent will leave when it is denied equal opportunity.  

    The New Economic Policy has outlived its usefulness and yet is being retained in one form or another. 

    This policy, which was supposed to help the Malays to advance economically, had in fact caused them to lag behind. They have become overly dependent on government handouts. UMNO Baru politics had caused the Malays to be mentally disadvantaged. 

    This is a worrisome situation. Extremists Groups like PERKASA and ISMA are out to exploit the situation. Their very presence and their nefarious activities if left unchecked can wreck this country.

    The political change must take place to avoid this catastrophe. 

    Pakatan as it is presently constituted cannot be relied on to bring about this change. Concerned citizens in the country will have to assert themselves and rally support for those moderate and liberal forces which seek a better future for the coming generations. 

    They need to support movements like Negara Ku and other civil society organisations.

    The year 2018 is not very far away and positive steps must be taken now.

    The vanguard for this very crucial mass movement will have to be the DAP. 

    PSM (Party Sosialist Malaysia) would probably be able to join in but the latter will have to shed its ideologue image.
