Japanese Voters Elected the OPPOSITION for the FIRST Time in Historic Election

Japanese voters swept the OPPOSITION Democrats to a historic victory in an election on Sunday, ENDING a Half-century of almost UNBROKEN RULE by the Liberal Democratic Party (LDP).

The voters usher in a (new) government that has promised to focus spending on consumers, cut wasteful budget outlays and REDUCE the power of bureaucrats.

[Note: The Liberal Democratic Party (自由民主党 Jiyū-Minshutō), frequently abbreviated to LDP or Jimintō (自民党), is the largest party in Japan .

LDP Japan for most of the years since its founding in 1955.

After a victory in the Japan general election, 2005, the LDP held an absolute majority in the Japanese House of Representatives and formed a coalition government with the New Komeito Party.

The party suffered a major defeat in the election of 2007, however, and lost its majority in the upper house for the first time in its history.

The LDP was the most "traditionally Japanese" of the political parties because it relied on a complex network of patron-client (oyabun-kobun) relationships on both national and local levels.

The LDP has the "you scratch my back, I'll scratch yours" character. Its success depended less on generalized mass appeal than on the so-called sanban (three "ban"): jiban (a strong, well-organized constituency), kaban (a briefcase full of money), and kanban (prestigious appointment, particularly on the cabinet level).

Opposition Democratic Party leader Yukio Hatoyama, 62 said,
" The people are angry with politics now and the ruling coalition.

We felt a great sense of people wanting change for their livelihoods and we fought this election for a CHANGE in government."
The RULING party loss ended a three-way partnership between the LDP, big business and bureaucrats that turned Japan into an economic powerhouse after the country's defeat in World War Two.

"This is about the end of the post-war political system in Japan," said Gerry Curtis, a Japanese expert at Columbia University. "It marks the end of one long era, and the beginning of another one about which there is a lot of uncertainty."

The Democrats will have to move fast to keep support among voters worried about a record jobless rate and a rapidly aging society that is inflating social security costs.

Japanese news agency Jiji said the LDP's performance was the party's worst since its founding in 1955.

Support for the LDP, which swept to a huge election win in 2005 on charismatic leader Junichiro Koizumi's pledges of reform, crumbled due to scandals and a perceived inability to address the deep-seated problems of a shrinking and fast-aging population.

"It's going to be challenging for the DPJ to allocate money properly, but I think we should give them a shot," said 38-year-old restaurant owner Yasuhiro Kumazawa. "If it doesn't work out, we can re-elect the LDP again in four years."

The Democrats have pledged to refocus spending on households with child allowances and aid for farmers while taking control of policy from bureaucrats, who are often blamed for Japan's failure to tackle problems such as a creaking pension system.

  6. Menteri Besar Tan Sri Abdul Khalid Ibrahim said such an act of religious intolerance was appalling and a step back in promoting efforts for mutual respect among the various races and religions. "The state calls on the police to act without fear or favour and conduct a fair investigation into the incident, including the threats issued by the demonstrators against state leaders," said Khalid in a statement.

    He added that a directive had been issued to the Shah Alam city council to hold an open discussion on Sept 5 for Section 23 residents, which would be attended by the council's officials and Selangor Economic Development Corporation representatives.

    The meeting would not only allow those affected to express their views but also provide the state an opportunity to present facts and reasons surrounding its decision to relocate the current temple in Section 19 to Section 23, Khalid said.

Izinkan aku memulakan kalini dengan ketawa berdekah2:

Kah… Kah… Kah!

Tiba2 gerombolan kepala lembu yang berdemo Jumaat lepas bagaikan tesentot telo2 mereka selepas tindakan bangang mereka dikutuk secara sebulat suara oleh semua orang, baik ameno, mahupun PR.

Ketua gerombolan yang nak jadi ‘hero Islam’, yang kebetulan nama nak sama dengan TPM ‘hero Melayu’, berpusing2 menjawab dan menafikan soalan berkaitan siapa yang membawa kepala lembu pada hari tersebut.

Dia kata dia tak tau. Pada hari 50 orang penyokongnya berdemo, sms telah bertebaran, dan juga di Facebook menyatakan ada perhimpunan dianjurkan bersama kepala lembu.

Pada waktu demo itu juga, ketua gerombolan ini menyatakan bahawa tidak akan berganjak walau seinci. Sanggup bermandi darah bagai.

Gambar2 di media2 juga memaparkan mereka mengusung kepala lembu, menyepak, dan menghina kepala lembu dengan kaki, meletakkannya di hadapan pejabat kerajaan, dan ‘mewakafkan’ kepala lembu yang masih berdarah tu kepada MB dan YB di situ.

Selepas sehari kejadian berlaku, dan kutukan serta kemarahan umat membara terhadap tindakan mereka ni, tiba2 semua peserta demo ni tak tau dari mana kepala lembu tu datang!

Kah… Kah… Kah…!!!

Ketua gerombolan cuba menaichi kepala lembu tu dengan mengatakan bahawa ianya ‘kerja orang luar’. Nak membuat kesimpulan bahawa himpunan mereka ‘disabotaj oleh kepala lembu’. Demo mereka yang tidak rasis dan anti-agama itu telah diganggu dan disalahtafsir disebabkan kepala lembu.

Aiseymen, encik lembu. Seluruh alam maya nampak berapa ramai yang datang demo encik lembu tuhari - lebih kurang 50 jer.

Kepala lembu tu jadi macam simbol korang haritu.

Kepala lembu tu lebih banyak dapat liputan daripada encik lembu sendiri.

  1. Takkan la encik lembu tak perasan ada kepala lembu?

  2. Kalau perasan, kenapa encik lembu tak tegur atau suruh buang?

  3. Adakah sebab encik lembu pun sukakan perkara tersebut?

  4. Adakah sebab encik lembu bersetuju dengan perkara tersebut?

  5. Adakah encik lembu tahu tentang perkara tersebut tetapi bertindak berdiam diri agar ianya boleh memprovok agama lain dan seterusnya menimbulkan huru hara, bergaduh sehingga menimbulkan MAGERAN di Selangor yang akhirnya menjatuhkan kerajaan PR dan inisiatif encik lembu akan dibayar dengan harga yang paling tinggi?

Sudah semestinya, kot?!

Jika tidak, takkanla encik lembu terus menerus menyokong tindakan itu dengan membekap (backup) dalam statement kepada watawan bahawa kepala lembu itu sebagai simbol kebodohan.

Encik lembu tidak membantah penggunaan kepala lembu tersebut.

Encik lembu membantah bina kuil, biarkan kepala lembu yang menjadi binatang suci Hindu dipermainkan, dan kemudian menambah kedukaan Hindu dengan mengaitkan lembu dengan kebodohan pada hari kamu membantah pembinaan kuil. Semua dalam satu tajuk yang sama!

Encik lembu… Encik lembu….

Untuk makluman encik2 lembu sekalian, rakyat tidak lagi bangang sepertimana yang diharapkan. Mereka memilih PR di Selangor, dan sudah semestinya setiap perkara yang dibangkitkan akan dicari jawapannya oleh pengundi.

Kenapa rakyat memilih PR? Sebab mereka memberi jawapan yang memuaskan untuk setiap tindakan mereka. BN tidak pernah menjawab soalan2 pengundi dengan baik, sebab itu mereka ditolak.

Dalam kes kuil, umum rakyat Selangor telah berjumpa dengan jawapan yang jelas, bahawa kuil2 baru tidak dibenarkan, dan kuil2 haram akan direlokasikan supaya memudahkan semua orang.

Tidak timbul soal majoriti atau minoriti, sebab kalau nak difikirkan majoriti, AMENO KENA KELUAR DARI SABAH SERAWAK SEBAB MELAYU DI SANA HANYA MINORITI!

Mereka yang baru berjinak2 dengan demokrasi, terbodoh dengan fahaman mereka sendiri bahawa hak majoriti itu mengatasi segalanya sekaligus menafikan hak minoriti. Bangang ka hapa?

Oklah. Tapayah kita bersoal tentang hukum dan peranan demokrasi. Itu bukan isunya.

Isunya di sini ialah encik lembu yang tidak berkata apa2 bila kepala lembu disepak tendang pada hari demo, bernada lain pada keesokan harinya.

Encik lembu dan gerombolan yang nak bermandi darah dan tak berganjak walau seinci pada hari demo telah berundur lapan tiang pada keesokan harinya apabila tindakan mereka itu dikutuk, bukan sahaja oleh orang Hindu dan bukan Islam, malahan dari orang2 kuat ameno sendiri!

Aku bukan nak provok, tapi sekadar nak memberikan gambaran jelas bahawa tindakan2 gerombolan ameno ini dari dulu, kini dan selamanya tidak pernah cerdik.

Dan bila mereka tau bahawa tindakan mereka itu telah dikesan bodohnya, mereka cepat2 bertindak dengan memperbodohkan orang lain.

Mereka ini tak pernah nak ambik tahu bahawa tahap kecerdikan orang di Tanah Melayu ini sudah meningkat berpuluh kali ganda selepas peristiwa ‘98.

Mereka ini - manusia2 gerombolan - adalah terdiri dari golongan orang2 yang jahil, dan untuk itu, blog ini diwajibkan ke atas mereka.

What If Non-Muslims Burn the Quran over a Mosque?

Umno Youth chief Khairy Jamaluddin has strongly condemned the protest against the relocation of a Hindu temple where angry residents paraded a severed cow's head this afternoon.

Khairy warned that such emotional acts could jeopardise peace in the country.

Calling on the protesters to reflect on their action, he asked:
"How would you feel if the proposal to build a mosque in a non-Muslim area - which is already happening - leads a group of non-Muslims to burn and stomp on the Quran?"

Would not the Malays rise with anger? If yes, then parading with a cow's head is just as insulting?

This act is surely to anger the Hindus .

If the residents were dissatisfied with the proposal to build a temple in their area, they should have used the existing channels to air their grouses.

I believe this is not an action condoned by Islam, a religion which espouses humility and respect for other religions.

Where is the spirit of 1Malaysia, especially among the Malay Muslims who are the majority in this country. I pray that this incident does not lead to anything more serious."

I would rise to defend the dignity of Islam if the religion is belittled, (and) I will also voice out if other religions are insulted."

He said although a memorandum submitted earlier by the residents might have failed to change the state government's stand on the issue, it was not an excuse to demonstrate in such an insulting manner as if this was an uncivilised country.

The Umno Youth leader added that he was saddened that the protest was done in the name of Malay non-governmental organisations and after Friday prayers in the month of Ramadhan.

Saya selaku Ketua Pergerakan Pemuda UMNO Malaysia dan Pengerusi Pemuda Barisan Nasional mengutuk sekeras-kerasnya demonstrasi membantah cadangan membina kuil Hindu dekat Seksyen 23, Shah Alam, petang tadi di mana kepala lembu diperarakkan ke bangunan Setiausaha Kerajaan Negeri Selangor.

Tindakan ini tidak langsung menyerlahkan sensitiviti dan penghormatan wajar terhadap agama dan kepercayaan orang lain yang perlu demi keharmonian antara kaum.

Sebaliknya, tindakan emosional dan menghina sebeginilah yang boleh membawa kemudaratan kepada keamanan negara.

Sekiranya mereka yang melakukan perarakan ini tidak senang dengan cadangan pembinaan kuil di kawasan perumahan mereka pun, mereka sepatutnya menggunakan saluran yang sedia ada untuk meluahkan ketidakpuashatian sejajar dengan semangat sivik atau kemasyarakatan.

Saya sedar bahawa memorandum membantah cadangan tersebut yang dihantar oleh Jawatankuasa Bertindak Bantahan Pembinaan Kuil Seksyen 23 kepada Anggota Dewan Undangan Negeri (ADUN) Batu Tiga barangkali tidak mengubah keputusan Kerajaan Negeri Selangor untuk meneruskan rancangannya membina kuil tersebut, berdasarkan kenyataan YAB Menteri Besar.

Namun, ini bukan satu alasan untuk wakil-wakil penduduk berdemonstrasi dengan cara menghina seolah-olah negara kita tidak bertamadun.

Kalaupun kemahuan mereka tidak tercapai, sensitiviti terhadap agama dan kaum lain tidak boleh sekali-kali diketepikan.

Yang menyedihkan bagi saya adalah demonstrasi ini diadakan atas nama NGO-NGO Melayu selepas solat Jumaat di bulan Ramadhan Al-Mubarak.

Saya percaya ini bukanlah tindakan yang diterima di sisi Islam, agama yang memuliakan kesederhanaan dan menghormati kepercayaan orang lain.

Tindakan ini sudah tentu akan mengakibatkan kemarahan orang Hindu dan rakyat Malaysia amnya.

Orang Melayu Islam yang menganjur dan terlibat dengan demonstrasi ini sepatutnya fikir sejenak, apa perasaan mereka jika
cadangan membina masjid di kawasan bukan Melayu – yang memang pun berlaku – membawa kepada golongan bukan Melayu membakar dan memijak Al-Quran?

Tidakkah orang Melayu akan bangkit dengan kemarahan membara? Jika ya, tidakkah perarakan kepala lembu yang dipenggal itu tidak serupa hina?

Di manakah semangat 1Malaysia yang wajar dipraktikkan terutamanya oleh orang Melayu Islam sebagai golongan majoriti negara ini? Saya mendoakan agar kelakuan petang tadi tidak akan membawa kepada sebarang insiden yang lebih serius.

Jika ada yang menganggap agama Islam dihina atau diperlekehkan sepertimana yang berlaku dengan isu jualan arak di negeri Selangor baru-baru ini, saya akan bangkit mempertahankan maruah agama Islam.

Tetapi saya juga akan bersuara sekiranya agama lain dihina. Islam mengajar kita untuk mengenali dan membuat baik dengan bangsa lain, sepertimana firman Allah SWT dalam surah Al-Hujarat, ayat 13:
"Hai manusia, sesungguhnya Kami menciptakan kamu dari seorang laki-laki dan seorang perempuan dan menjadikan kamu berbangsa-bangsa dan bersuku-suku supaya kamu saling mengenal."
Dan surah Al-Kafirun, ayat 6:
"Untuk kamu agamakamu, untuk aku agama aku".
Maka budaya menerima kepelbagaian agama ini termaktub dalam kitab suci Al-Quran.

Kepada umat Islam, marilah sama-sama kita menghayati ajaran agama yang sebenar.

Janganlah kita mencemari bulan Ramadhan Al-Mubarak ini dengan tindakan dan perbuatan yang menghina orang lain.

Salah tetap salah. Benar tetap benar. Wallahualam.

Selama 52 tahun negara kita aman makmur, tiba-tiba ada pihak cuba hancurkan semua ini, sengaja nak buat kacau.

“Dulu mereka diberi kerakyatan setelah setuju mahu patuhi syarat-syarat yang diberi, kalau tak suka lagi, keluarkan mereka dan kalau ada orang Melayu sendiri tak suka, keluarkan juga mereka dengan melucutkan kerakyatannya.

Jangan kerana politik, mereka sanggup menjual agama. Dalam Islam, kita diwajibkan untuk pertahankan agama daripada dihina, bukan melakukannya kerana kepentingan diri.

Pada masa yang sama, Islam juga tidak membenarkan umatnya menghina agama lain kerana perbuatan saling menghina itu hanya akan menyebabkan berlaku suasana tidak tenteram.
Beliau mengulas kemarahan orang Melayu terhadap kandungan satu blog baru-baru ini menghina Islam, Sultan Perak, Sultan Azlan Shah serta Raja Muda Perak, Raja Dr. Nazrin Shah.

Sebelum itu pelbagai pihak turut mengkritik tindakan Exco DAP negeri Selangor, Ronnie Liu yang campur tangan dan mempertikaikan tindakan Majlis Bandaraya Shah Alam (MBSA) merampas minuman keras di Seksyen 8, Shah Alam dan tindakan Ketua Staf Pejabat Ketua Menteri Pulau Pinang, Jeff Ooi mengaitkan syariah Islam sebagai ekstremis.

Menurut Harussani, setiap orang Islam wajib mempertahankan agamanya daripada dihina oleh mana-mana pihak dan tidak seharusnya menyokong penghinaan itu dengan apa sahaja alasan.

Some 50 residents - from Section 23 in Shah Alam - who gathered after the Friday prayers at the state Mosque, placed the decapitated head of a cow outside the gates of the state secretariat building in protest against the proposed relocation of a Hindu temple to their area.

The protesters had marched some 300m from the state mosque to the state secretariat building.

The cow is considered SACRED among Hindus.

Before dispersing, several protesters spat and stomped on the cow's head.

Addressing the crowd, Section 23 action committee deputy chair Ibrahim Sabri threatened:
" If there is blood, you (the state government) will be responsible if you are adamant about building the temple.

"This is a warning. Relocate the temple to Section 22. This cow is a present to the state government. This is a gift from us.

We will not budge one inch, even if lives are lost or blood is made to flow. We will still defend Section 23 from having a temple built there."
The MIC secretary-general,Dr S Subramaniam, who is also Human Resources Minister, said PM Najib had conveyed his disappointment when he telephoned him regarding the incident.

Subramanium said,
"The prime minister was very upset. He promised to look into the problem and nip it in the bud.

Some 15 minutes later, the prime minister called back and said that he had spoken to Inspector-General of Police (Musa Hassan) and instructed him to take immediate action."
Selangor executive councillor Dr Xavier Jeyakumar described the protest as "unwarranted, unacceptable and without sensitivity towards other religions."

He said,
"These people should have ethics.

They are inciting racial and religious hatred.

I am going to lodge a police report against these people."
MIC president S Samy Vellu , > who called it an "intolerable" act carried out by an "extremist group." He called on the government and the police to take action against the organisers of this protest. They must be punished according to the law for endangering racial harmony in this country, he added.

Samy Vellu said,
"The cow is a sacred animal of the Hindus, and for this group to resort to such action, is intolerable and tantamount to challenging the freedom of religion as enshrined in the Malaysian Constitution.

It is the right of Malaysians of any faith, including Hindus to build temples and other places of worships.

I am very sad that this group had paraded the cow's head on their way to the state secretariat building.

We must not allow anyone to challenge or ridicule any religion in this country.

I am worried that this action may lead to retaliation from the Hindu community. However, I wish to urge the Hindus especially to be calm and let the authorities deal with it. "
Penang Deputy Chief Minister II P Ramasamy< called the protest a "disgraceful" act. "It was very uncivilised and brutish...and the group had just come after attending their (Friday) prayers," the DAP leader said.

MIC Youth was also appalled and expressed shock over the protest.

The wing's chief T Mohan said,
"It is a very shameful and disgraceful act and they do not seem to have any feelings for the sentiments of the Hindu community.

We strongly condemn their actions and call on the authorities to take immediate action. There are proper channels to express one's views but ridiculing the Hindu religion reflects the shallow minds of the protesters."

Human Rights Party leader P Uthayakumar was disappointed that the police did not arrest those involved in the protest.

He said the Attorney-General's Chambers should initiate criminal proceedings and charge them under Sections 298 and 298 (A) of the Penal Code read together with Article 11 of the Federal Constitution.

Section 298 concerns the offence of uttering words etc with the deliberate intent to wound religious feelings while Section 298 (A) is related to the offence of causing disharmony.

Makkal Sakthi Party president S Thanendran also condemned the protest as a "barbaric" act.

He urged the Selangor government as well as the police not to tolerate this sort of behaviour and to take stern action against the protesters.

"How can a temple disturb the peace of these people? Things can become really ugly if we start raising other questions," he said.

The Malaysian Syarie Lawyers’ Association (PGSM) issued a joint statement with Pembela, an umbrella body of several Muslim NGOs, saying everyone SHOULD ADHERE to and RESPECT the decisions made by the SYARIAH courts.

When Minister Hishamuddin said that we are not experienced in this matter, he was stating the obvious.
  1. Firstly, no person of the female gender has been caned or sentenced to caning in Malaysia before. The reason for this will be obvious later in this article.
  2. Secondly, the authorities entrusted with carrying out the sentence of caning in Malaysia had never ever caned someone convicted of the Syariah offence of consuming alcohol in public.
Questions then arise as to how, where and by whom should Kartika be caned.

While I do not wish to be embroiled in the debate on whether Islam actually prohibits the consumption of alcohol and prescribes a punishment for it, I wish to state that such issue is not as clear as it is thought to be.

There is however a decision from the Pakistan Federal Syariah Court which held that there is NO clear prohibition against consumption of alcohol in the Quran and that FLOGGING for such offence is thus UN-ISLAMIC. I am citing this decision not so much to support any argument on whether the prohibition exists or otherwise as much as to highlight that this issue is far from being clear.

Muslims around the world - and Malaysian Muslims aren't exempted - have lamented that Islam has been misunderstood by non-Muslims, especially in the west.

Islam has been cast:

  • as a religion which propagates disharmony;

  • as a religion which sanctions the killing and murder of the innocent, women and children;

  • a religion which is backward, primitive, unfair and unjust.

However, to a large extent, we, the Muslims, have ourselves to blame.

A case in point is the provisions of the Enakmen Pentadbiran Ugama Islam dan Adat Resam Melayu Pahang 1982. Under this enactment, a Muslim who is guilty of consuming alcohol in public may be fined RM5000 or imprisoned for 3 years or both and caned of not more than 6 lashes. Kartika was convicted and sentenced under this enactment.

My learned friend, Shaikh Abdul Saleem, in his excellent article "Soalan Kepada PGSM" , has pointed out the whole reason why Islam has been ridiculed by the west for so long. He draws comparison to the provisions of the Enakmen Undang-Undang Keluarga Islam 2005 (Pahang). Under this enactment:

  • someone who treats his wife badly and cheats her of her property is liable to be fined RM1000 or imprisonment for 6 months;

  • someone who does not comply with a Court order to live with his wife is liable to a fine of RM1000 or imprisonment for 6 months;

  • someone who does not treat his wife fairly in accordance with Syarak is liable to a fine of RM1000 or imprisonment for 6 months.

If that is not shocking enough, consider section 177 of the Enakmen Pentadbiran Ugama Islam dan Adat Resam Melayu Pahang 1982 (the enactment under which Kartika is sentenced). Under this section, a person who forces or allows his wife to prostitute herself with the intention of earning an income from such prostitution is liable to be fined RM4000 or imprisonment for 2 years or both and caning of not more than 6 lashes.

So, there we have it.
  • RM5000 fine or imprisonment of 3 years and 6 lashes for consuming alcohol.
  • And RM4000 or imprisonment of 2 years and 6 lashes for forcing one's wife to be a prostitute!

Is there any wonder why Islam is viewed with ridicule and contempt?

We seem to have lost it.

Somewhere between the Quranic verses, the hadiths and Sunnah and the various edicts by the ulamaks and muftis:

  1. WE , the Muslims, have managed to reduce this great way of life called Islam into an instrument of hatred, unfairness, unjustness and ridicule.

  2. WE have managed to let externalities triumph over the inner beauty and spirituality of Islam.

Under Syariah law, some consensus has been reached on the proper punishment (if at all it can be called "punishment") for consuming alcohol. Various hadiths Bukharis describe the Prophet and his followers beating the offender with palm-leaf stalks and shoes.

In a hadith, narrated by Abu Salama, Abu Huraira said,

"A man who drank wine was brought to the Prophet. The Prophet said, 'Beat him!" Abu Huraira added, "So some of us beat him with our hands, and some with their shoes, and some with their garments (by twisting it) like a lash, and then when we finished, someone said to him, 'May Allah disgrace you!' On that the Prophet said, 'Do not say so, for you are helping Satan to overpower him.' "

In another, narrated by Ali bin Abi Talib:

"I would not feel sorry for one who dies because of receiving a legal punishment, except the drunk, for if he should die (when being punished), I would give blood money to his family because no fixed punishment has been ordered by Allah's Apostle for the drunk. "

And those were the "punishments" meted by the Prophet himself.

There are however narrations which say that Caliphs Umar had sentenced an offender to 80 lashes. It was pointed out by Imam Feisal Abdul Rauf, the Chairman of the Cordoba Initiative, that that was in fact a sentence for slander as opposed to consumption of alcohol per se.

If it was indeed a sentence for consuming alcohol, that begs the question, who is Caliph Umar to increase a punishment which was meted out by the Prophet himself?

Kartika has however been sentenced to receive 6 lashes.

The enormity and gravity of this sentence cannot be overlooked nor ignored. First of all, there is no procedure anywhere in Malaysia on how a sentence of this nature would be carried out in Malaysia.

  1. Is she going to be beaten up with shoes or date palm?
  2. Or with garments which are twisted like a lash? And by whom?

  3. And where?

Our authorities are well known of churning out half baked products.

And one of those products is the law which our Parliamentarians or State Representatives churn out.

The law says she must be caned. But there is no procedure to prescribe the execution of such caning.

Criminal Procedure Code

Do we look at the civil law on how she should be caned? Okay. Let's us all look at the civil law then. The Criminal Procedure Code provides as follows in so far as a sentence of whipping is concerned. (Frankly, I do not know the difference, if any, between whipping and canning.)

  • Section 286 : when an accused is sentenced to whipping, the Court may direct on the place and time of execution.

We pause here to note that the Syariah Judge, as far as I know, had failed to give such direction.

Furthermore, this provision does NOT apply to a sentence by a Syariah Court because "Court", in the Code, is defined as the Magistrate's, Sessions or High Court.

We are none the wiser.

Section 287 is important. It says when a person is sentenced to imprisonment as well as whipping, such whipping shall only be done after 7 days from the date of the sentence. This section is important because of what happened sometime last week.

Kartika was sentenced to a fine of RM5000 and 6 lashes. There was no custodial or prison sentence.

And to top it up, there was NO direction on how she was to receive the lashes.

So what did they do?

  1. Last week, it was reported that the Syariah prosecutor had applied to the Syariah Judge, and was granted, an order that Kartika be detained in remand in the prison for 7 days so that she could be caned in the prison.

  2. With all due respect to this two officers of the law (officers of the Islamic law, if I may add), a grave error and injustice has been committed against Kartika. A person can only be charged and sentenced ONCE for ONE offence. Kartika has been charged, found guilty and sentenced to RM5000 and 6 lashes. That was her sentence.

    Nowhere had it been stated that she was to be imprisoned for 7 days.

  3. The learned Syariah Judge, at the instance of the Prosecutor realised that the caning cannot be done.

  4. And so they issued a new and additional sentence of 7 days in prison. If that is not an injustice, I do not know what is.

If I were to be nasty, I would say that that was a victimisation!

That order, with respect, is in fact unconstitutional as it is repugnant to Article 7 of the Federal Constitution which provides that a person shall NOT be tried TWICE for the SAME offence.

Can the sentence be carried out by the Prison authorities? Well, the Criminal Procedure Code (our civil law), in section 288, says that:

  • whipping shall be inflicted on such part of the body as the Minister charged with responsibility for public order directs. The Minister in question is of course Minister Hishamuddin. The part of the body to be whipped has been directed. It is the bare buttocks. The person who carries out this sentence is a trained personnel.
  • the rattan shall be not more than half an inch in diameter.

Let me describe how this whipping is done.

  1. The executioner would hit the bare buttock with the rattan with such ferocity that upon the rattan hitting the bare buttock, the offender would fling forward.

  2. The executioner then would expertly pull the rattan towards himself in one swift movement that the skin would cut open, as if it has been cut by a very sharp knife.

  3. At this point, blood would rush out of the open wound.

  4. The next round, the executioner would expertly hit the same area where the first blow had landed earlier. The wound would get bigger.

That's how. And it is supposed to go on for 6 times, in Kartika's case.

In real life, NOT many would be standing up to receive their 5th lash.

That is why a the Code provides that a medical officer must be present to certify that the offender is fit state of health to undergo the whipping. If a person is not fit to receive the full number of lashes, the whipping must stop and the remaining number may be converted into a prison sentence or remitted.

That is how whipping under our CIVIL law is done.

If we compare that to the way the Prophet was described by the hadiths to have dealt with the offender, the civil law whipping is much much more painful and harmful than that which is prescribed by the hadiths.

In fact they are not comparable at all.

The CIVIL law whipping is so harsh and painful that even fearsome and hardcore gangsters have pleaded to the Court to be spared whipping.

The Syariah punishment is however aimed at humiliating the offender rather than inflicting pain.

And to top it up, the Code says expressly that WOMEN shall NOT be subject to the sentence of whipping!

And to facilitate whipping under the Code, a warrant of execution must be issued by a Judge or Maigistrate.

A Syariah Judge is NOT a Judge under the Code.

If Kartika were to be caned under the civil law, I would venture to say that she would be punished in a manner which is NOT prescribed by Syariah law in the first place.

That would be a travesty. And it would be an irony that a Muslim court had seen it fit to impose a punishment which is not prescribed by Syariah law.

Where does that leave Kartika?

More importantly, where does that leave Malaysia?

The political cost of caning Kartika

MALAYSIA has long been trying to cultivate its image as a moderate Muslim state that can serve as an exemplary model for others.

Particularly in the wake of the attacks on the United States in 2001 and during the heated years of the war on terror, successive Malaysian Prime Ministers have worked hard to ensure that Malaysia would remain on the list of moderate Muslim states that could serve as the cultural bridge between the Western and Muslim worlds.

Today, however, that image stands to take a significant pounding thanks to a relatively isolated incident that has managed to grab the headlines worldwide: A Malay-Muslim woman by the name of Kartika Sari Dewi is set to be caned for the offence of drinking alcohol in public.

Kartika's case has bedevilled the lawmakers of Malaysia for the simple reason that nobody seems to know what to do about it, and her. Kartika was found guilty of drinking beer in the state of Pahang, West Malaysia. The religious authorities of Pahang subsequently found her guilty of committing a syariah offence, and she was made to pay a fine.

Kartika herself pleaded guilty, but was also sentenced to six strokes of the cane. What baffles most observers of Malaysian politics is that the former model then stated that she was prepared to be caned, and what is more, to be caned in public. Former Malaysian Prime Minister Mahathir Mohamad has reacted to the case by asking the thorny question of whether Malaysia will celebrate its independence day with the caning of a Muslim woman instead.

Prime Minister Najib Razak has himself asked Kartika to appeal her sentence, and to reconsider.

Needless to say, the case had made international headlines and brought Malaysia to the world's attention for all the wrong reasons.

The problem that this case poses for Malaysia is complex and manifold: For a start, Kartika's case that was handled by the Syariah court of Pahang now raises the question of whether the Federal government can intervene to save her. Federal-state relations in legal matters will therefore be the crux of the legal side of the debate.

Adding to the confusion is the problematic and complicated relationship between religion and politics in the country, where the borderline between Islam and politics has grown increasingly blurred after three decades of state-driven Islamisation.

Malaysia's enfeebled ruling UMNO party is now trying its best to defend its own Islamic credentials in the face of the opposition Islamic party PAS, but at the same time would not like to see Malaysia gain the same reputation as the Taliban of Afghanistan.

The Islamic party in turn is likewise split in its conscience, between moderates who wish to push the democratisation agenda and conservatives who wish to lay the foundations for more Islamisation.

Already in the state of Selangor where PAS has come to power as part of the Pakatan Rakyat coalition, moral policing has been introduced by the conservative PAS leader Hasan Ali, who has called for religious functionaries to arrest Muslims who go against Islamic law.

In the long run however, all these internal changes will be tempered by realpolitik considerations. The conservatives of PAS may feel that their electoral gains thus far have given them the green light to further Islamise the country, calling for a ban on the sale of alcohol, music concerts, and compelling Muslims to abide by Islamic norms and regulations.

But in the wider context of international politics Malaysia is looking more and more like an isolated, parochial state where books are banned and people are whipped for doing things that are regarded as perfectly normal elsewhere.

The conservative Islamists of Malaysia, their religious convictions notwithstanding, simply do not seem to understand how and why the international community is upset with the idea of a woman being caned for drinking a pint.

A case in point is the Mufti of Perak, Harussani Zakaria, who even asked why there was such a fuss being made about a woman being caned six times when, in his opinion, the punishment ought to have been 80 lashes instead?

It is this deep-rooted sense of disconnect that adds a surreal air to the goings-on in Malaysia today, and the case of Kartika herself. The Malaysian government is concerned that failure to enact Islamic law and punishment will compromise its standing in the eyes of conservative Muslims in the country; but to have Kartika caned would jeopardise the country's image internationally.

Like it or not, Malaysia still depends on trade and international goodwill from the developed countries of the West, not Afghanistan. This, then, is the dilemma that Malaysia faces at the moment, and there seems little consensus on how to proceed.

Kartika's caning has been postponed to the end of the month of Ramadan, but this buys precious little time to resolve what has to be a landmark case in Malaysian syariah law.

One thing, however, is certain: The costs of caning Kartika are simply too high, and should that line be crossed the country would have jumped one rung up the Islamisation ladder yet again.

From then on, there is no turning back and this may be a sign of what is to come in the future.

Kartika Sari Dewi Shukarno cannot file an appeal against a sentence of caning because the 14 days for her to do so expired on Aug 3.

State Religious Department (Jaip) chief prosecutor Datuk Abdul Rahim Jaafar said it was now up to Syariah Chief Judge Datuk Abdul Hamid Abdul Rahman, who is also the state Syariah Court of Appeal chief judge, to revise the decision of the Syariah High Court judge on July 20.

Kartika, 32, was fined RM5,000 and sentenced to six strokes of the rotan by the Syariah High Court here after she pleaded guilty to drinking beer at a hotel nightclub in Cherating in 2007. The part-time model settled the fine but refused to make an appeal as she said she was ready to be caned. Read here for more

The religious authorities are capable only of SELECTIVE persecution.They target the economically disadvantaged groups and the LESS powerful.

Why don't you appoint
GOONS (Guardians Of Our Nation's Souls) to be gendarmes at those posh hotels and other happening places- catch also the economically ADVANTAGED and MORE POWERFUL.

Even members of royal families...."

The Pahang (Islamic) religious authorities insist on the caning of the model caught out drinking beer. They are only implementing the word of God. That makes them emissaries of God's spoken words.

All right thinking Muslims will not quarrel with this righteous stand.

If the lady in question doesn't want to appeal, that's up to her. She will receive her punishment in due course. She will know that with each stroke, part of the skin and flesh will be taken out. They will leave permanent scars. I was told that when men convicts get caned, they passed out and the severity of the pain causes permanent damage to their reproductive capabilities.

It is probable then, Kartika Sari Sukarno will be barren for the rest of her life. This punishment will make Pahang the most Islamic of the states in Malaysia.

A few years back, I was amused to hear the then Menteri Besar of Kedah, Sanusi Junid (a favourite of mine for his zany but practical ideas) claimed that Kedah is more Islamic than Kelantan. In Kedah, even married couple can be caught for close proximity (khalwat). Sorry Tan Sri, Dato' Sri Adnan who is your admirer has outdone you.

But I would also like to see the Pahang religious authorities be consistent and steadfast and uncompromising in the application of God's laws.

No double standards ok?
  • What if you catch out our social luminaries, leaders and even members of the royal family partaking in the same intoxicating beverage?

  • Do you have the righteous balls to mete out the same sentence?

If you don't, you will book yourselves a first class ticket to hell.

I have long been puzzled by a very common observation. Most of the time, why is it, that the people ( Malays) who get caught and convicted for various religious offences usually belong to some specific socio-economic group?

Women caught and convicted for various religious offences come before the religious courts come wearing tudungs and appropriate garbs. Men come with the skullcaps ( kopiah/songlok) on.

On appearance alone, they could pass as being people of religious bearings and possibly content. And this is even more perplexing. They come mostly from the lower economic strata- factory workers, unemployed, shop girls. Men= unemployed, taxi drivers, FELDA settlers etc.

Ask yourselves this question: why are those people caught out belonged to the economically depressed groups? Kartika Sari Dewi ( the name sounds similar to sukarno's Japanese wife) doesn't look as if she comes from the group staying at Damansara Heights, the night owls of Bukit Tunku or the hip crowd at Bangsar's Menerung super condo.

Hassan Ali, the PAS executioner- the man who speaks with flailing arms and the man who induces us to use umbrella if sitting in front of him when he speaks, wants to 'tangkap' bar and pub workers and whoever else who do not fit into his religious profiling.

To me, the religious authorities are capable only of selective persecution. They target the economically disadvantaged groups and the less powerful.

Why don't you appoint GOONS (Guardians Of Our Nation's Souls) to be gendarmes at those posh hotels and other happening places- catch also the economically advantaged and more powerful.

Even members of royal families.

A little oversight, and Malaysia's image will nosedive to the same levels of Sudan, or Afghanistan, Pakistan or Iran.

Malaysian woman Kartika Sari Dewi Shukarno was sentenced to six strokes of rotan by the syariah court in Pahang for beer drinking.

Certain enough, with that one lash, there'll be NO turning back for Malaysia. The country will be seen as one that flogs a woman on religious grounds.

Conservative religious clerics and outfits ( read: PAS) keep exerting pressure, and will NOT call it a day until and unless a stroke has landed on Kartika's body. But that stroke will send the Islamisation a big stride ahead.

If a precedent is set (by caning Karthika Devi) , any punishment in the name of religion in future will be justified, including punishments handed down on women.

If Kartika is eventually caned, the country's image will invariably come under the invisible punishment of the international community. If this were to take place, the government will have problem getting international recognition no matter how hard it sells its "
open and moderate" image.

Year after year, Tourism Malaysia has been spending enormous amounts of money to promote
"Malaysia, Truly Asia."

A verdict by the syariah court in Pahang has surpassed 10 years of effort by Tourism Malaysia in getting the country exposed in international media.

Not too long ago, Sudanese woman Lubna al-Hussein was sentenced by the court to 40 lashes for wearing pants, much to the shock and ridicule of the entire world.

All of a sudden, Sudan was treated free propaganda on global media, and the country was seen on the same ground as autocracy, backwardness, inhumanity and anti-feminism.

Who would want to visit or invest in a country like this?

Thanks to publication taboo, the "Kartika Sari Devi" incident in Malaysia has not been given enough weight by local media; but the news has been carried far and wide by international players such as CNN, BBC, The Associated Press, Reuters, The Wall Street Journal, New York Times, as well as their counterparts in Asia.

Indeed, drinking is haram, unlike wearing pants, but to international media, they are all thrown into the same category.

Malaysia has over and again emphasised that it is practising moderate Islam, and under the auspices of "moderation," a person infringing upon religious taboos should be served with exhortation or light penalties such as small-amount fines.

Even moderate and open-minded Muslims feel the so-called taboos are a relationship between the believer and God.

If punishment must be served, it should be God who passes down the verdict, NOT anyone else.


Some in the government are indeed aware of the seriousness of this issue, hence the last-minute halt to the caning and Najib's advice that Kartika should appeal.
