The Scorpene scandal and the long arm of the law

WHEN it comes to an issue like corruption, nations have long since accepted that it cannot be combated single-handedly.  A significant milestone in cooperation was when the General Assembly of the United Nations (UNGA) in New York passed the United Nations Convention against Corruption (UNCAC) on 31 Oct 2003.

Shortly after, Malaysia signed the UNCAC on 9 Dec 2003.  The UNCAC came into force on 14 Dec 2005. We then ratified it on 24 Sept 2008.

As a party to the UNCAC, how well do our government ministers understand Malaysia’s obligations under this international treaty and local laws on international cooperation on criminal matters?

 Defence Minister Datuk Seri Ahmad Zahid Hamidi’s recent snubbing of the inquiry by a French court into the Scorpene submarines scandal suggest ignorance, at the very least.

How UNCAC works

Under the UNCAC, state parties agree to cooperate with one another in every aspect of the fight against corruption, including prevention, investigation, and the prosecution of offenders. State parties are bound to render specific forms of mutual legal assistance in gathering and transferring evidence for use in court and to extradite offenders. 

There is a provision whereby state parties that do not have extradition treaties with each other may use their common membership of the UNCAC as the basis for any extradition request. They are also required to undertake measures which will support the tracing, freezing, seizure and confiscation of the proceeds of corruption.

Another over-arching trend in the international fight against transboundary issues is universal jurisdiction. A country can bring to trial and prosecute in that country, those accused of having committed a crime in another country. 

An area relatively new to Malaysia, we are only beginning to adopt universal jurisdiction through recent amendments to Section 4 of the Penal Code. This expands the scope of extraterritorial offences to include damage to property belonging to, or operated, or controlled, not just by a Malaysian federal or state government, but also to a Malaysian company or individual located outside Malaysia.

 This addresses our lack of laws to prosecute offences such as the hijacking of a Malaysian privately-owned (but foreign-flagged) ship by Somali pirates in international waters.

Bearing this in mind, Ahmad Zahid’s response to the possibility of being subpoenaed to appear in a French court to answer questions about the Scorpene affair is surprising for a number of reasons. France is also a signatory to the UNCAC, having signed it on 9 Dec 2003, and ratifying it on 11 July 2005.

The investigation by the French courts into allegations of transboundary corruption in the purchase of two Scorpene submarines by Malaysia would be precisely the kind of issue that UNCAC and universal jurisdiction are intended to address. By ratifying the treaty, Malaysia has signified to the world our willingness to submit to an international framework of cooperation in this regard. 

The Defence Minister’s comments, then, seem totally out of line with our international obligations.

Ahmad Zahid reportedly said, “Why should I appear?  I am not a witness!  If I appear, who will pay for my expenses?  I don’t want to use my money and the government’s money.”

In so doing, he clearly revealed his lack of familiarity with the Mutual Assistance in Criminal Matters Act 2002.  Part II of this Act deals with requests to Malaysia by foreign governments. In particular, Section 27 of the Act deals with requests for attendance of a particular person in another country to give evidence or assist in a criminal matter there.  

Malaysia’s Attorney-General can be requested by foreign authorities to arrange for the person to attend such proceedings. Section 19 specifically requires the Attorney-General to confirm that “allowances” and “arrangements for security and accommodation for the person” are to be made by the requesting foreign authorities.

So really, Ahmad Zahid need not worry about spending his own money or that of the Malaysian Government. France would pick up the bill, merci beaucoup.

Ahmad Zahid’s own ignorance aside, Malaysia’s attitude towards the Scorpene probe is also an issue of political will. 

Even though France is not a “prescribed foreign State” pursuant to Section 17 of the Act, Section 18 of the Act allows the Attorney-General to give special direction in writing for the Act to apply to that state. There is room for ad-hoc cooperation with France, if the Attorney-General recommends it and if the minister in charge of law agrees.

International perception

Malaysia could still refuse to entertain a request from France and would have grounds to do so in Section 20 of the Act.  These include:

• Section 20(1)(g): the facts constituting the offence to which the request relates does not indicate an offence of sufficient gravity;
• Section 20(1)(h): the thing requested for is of insufficient importance to the investigation or could reasonably be obtained by other means;
• Section 20(1)(i): the provision of the assistance would affect the sovereignty, security, public order or other essential public interest of Malaysia.

However, Malaysia should be cautious of how a refusal would be perceived by the international community in such a high-profile case. Care must be taken not to give a wrong impression.

No doubt, the Act contains complex provisions which include the voluntariness of a witness to travel to another country to assist in a criminal probe. The details of the Act’s provisions are beyond the scope of this article but suffice to say, the Minister of Defence should not have been so quick and glib in his reaction. 

Provisions do exist in Malaysian law to send him for an all-expenses-paid trip to Paris.  He should seek legal advice. 

Had he done so, he might have not been so glib again with his latest reaction — “Who are they to issue a warrant of arrest? We are not subjected to French laws.”

‘Red notice’ option

 

There is still the possibility that France could request countries, with which it has a mutual assistance in criminal matters agreement, to detain Ahmad Zahid and deliver him to Paris. 

This could happen should Ahmad Zahid travel to any such country or to any country which is a member of the European Convention on Mutual Assistance in Criminal Matters. No doubt he would then have to fight it, just as, under different circumstances, Julian Assange is currently fighting his extradition from the United Kingdom to Sweden.

It is open for the French courts, if Ahmad Zahid refuses to answer a subpoena, to upgrade that subpoena to an international warrant of arrest, and to seek the assistance of Interpol to effect it.  

This is known as a “red notice”.  Whether the French would actually do that is a tale for another time.

Hari ini pada 63 tahun yang lalu, tepatnya pada 21 Mei 1949, Rejimen Ke-10 telah dirasmikan di hutan Kerdau Daerah Temerloh, Pahang. 

Rejimen Ke-10 adalah sebuah pasukan gerila Melayu, terdiri dari putera puteri kaum buruh dan tani Melayu yang inginkan kemerdekaan penuh tanah air dan pembebasan rakyat.

Bapa Abdullah C.D. seorang anggota KMM (Kesatuan Melayu Muda) dan anggota Jawatankuasa Pusat PKMM (Parti Kebangsaan Melayu Malaya) adalah penaja dan pemimpin pasukan ini dari awal sampai akhir. 

Berikut adalah petikan tulisan Abdullah CD berkenaan penubuhan Rejimen Ke-10.
 
Penubuhan Rejimen Ke-10

Rejimen Ke-10 adalah sebuah pasukan Melayu Tentera Pembebasan Nasional Malaya.

Rancangan untuk mendirikan pasukan gerila Melayu telah dirancang dan diperbincangkan dalam Sekolah Parti Kem Se-Malaya pada pertengahan Jun 1948 (lihat bab 35).

Mengikut rancangan asal, di Temerloh akan didirikan satu kompeni dipimpin Kamarulzaman Teh, satu kompeni di Jerantut dipimpin Rashid Maidin dan saya mendirikan satu kompeni di Benta. Akan tetapi, apabila Kamarulzaman dan Rashid Maidin ditangkap, semuanya telah berubah. Saya ditugaskan untuk menggantikan Kamarulzaman memimpin pasukan di Temerloh.

Masa penubuhan Rejimen Ke-10 tidaklah dirancang dari awal atau boleh juga dikatakan secara kebetulan sahaja. Ketika itu, saya sedang memimpin Platun 1 bergerak di Jerantut. Chen Nan mengirim surat melalui utusan meminta saya pulang ke Kerdau untuk bermesyuarat. Saya bertolak meninggalkan Platun 1 ke Kerdau bersama beberapa orang pengawal. Dalam perjalanan pulang, saya melalui Gong. Massa Tionghua di situ menghadiahkan saya sedikit sumbu badak (tanduk badak sumbu). Mengikut keterangannya ia menjadi ubat yang paling baik untuk pelbagai penyakit.

Sepeninggalan saya, dalam Platun 1 timbul pertentangan antara orang Jerantut dengan orang Temerloh. Orang Jerantut di wakili Wan Ali mahu pertahankan Jerantut manakala orang Temerloh diwakili Budin mahu pertahankan Temerloh. Kerana pertentangan itu, orang Temerloh dalam Platun 1 juga bertolak balik ke Kerdau mengekori saya dari belakang. Tak lama saya tiba di Kerdau, mereka juga sampai.

Dalam pada itu, satu platun di bawah pimpinan Musa Ahmad dan Wahi Anuar telah diserang tentera British. Dalam pertempuran itu Wahi berpecah dengan pasukan. Komander Platun, Hasan sangat marah terhadap Wahi. Hasan akhirnya memimpin platunnya pulang ke Kerdau. Dalam masa yang sama Wahi dan Musa yang berpecah dari pasukan juga tiba di Kerdau. Jadi secara tidak dirancang, kami semua telah berkumpul di Kerdau.

Kerana kami semua sudah berkumpul, Chen Nan mengadakan perbincangan dengan kami iaitu saya, Musa dan Wahi untuk mendirikan Rejimen Ke-10. Kebetulan pula hari yang kami tetapkan itu ialah tanggal 21 Mei 1949.

Rejimen Ke-10 dirasmikan dalam suatu perayaan yang penuh khidmat dan meriah. Perayaan itu dihadiri oleh Chen Nan, 3 orang pimpinan bahagian Melayu iaitu saya, Wahi dan Musa bersama 2 platun pasukan asas (Platun 1 dan Platun 3). Selain itu terdapat Kompeni Khas Rejimen Ke-6 di bawah pimpinan Hong Yi dan satu kompeni pasukan Tionghua yang baru datang dari Raub, kira-kira 200 orang semuanya.

Chen Nan selaku wakil Jawatankuasa Pusat mengisytiharkan berdirinya Rejimen Ke-10 TPNM dan menyampaikan ucapan. Yang penting ditegaskannya ialah Rejimen Ke-10 adalah tentera Melayu - dari komander hingga ke perajuritnya terdiri daripada putera puteri terpuji bangsa Melayu; Rejimen Ke-10 adalah lambang kemegahan kaum tani Melayu yang luas.

Kemudian saya membuat ucapan, pokoknya menyatakan keazaman pasukan Melayu untuk teguh berjuang demi kemerdekaan ibu pertiwi, memikul harapan nusa dan bangsa khasnya membangkitkan kaum tani yang luas untuk kemerdekaan tanah air dan pembebasan nasional. Sebagai pasukan tentera rakyat kami haruslah tegas mematuhi disiplin TPNM.

Johan telah mempersembahkan 2 lagu berentak march bertajuk TENTERA PEMBEBASAN NASIONAL dan BARISAN GERILA MALAYA. Lagu itu dipersembahkan dengan gaya yang amat menarik. 2 buah lagu ini menjadi lagu rasmi Rejimen Ke-10. Johan adalah seorang pejuang internasionalis dari Indonesia.

Badan pimpinan Rejimen Ke-10 pokoknya berdasarkan ketetapan di dalam persidangan kader di Sekolah Parti Kem Se-Malaya, cuma sedikit perubahan kerana Kamarulzaman dan Rashid Maidin masih di dalam penjara:

• Komisar Politik Abdullah CD
• Panglima Wahi Anuar
• Pegawai Politik Musa Ahmad

Sebelum Rejimen Ke-10 didirikan, PKM telah mendirikan  Ke-9 rejimen TPNM, asasnya ialah 8 Rejimen Pasukan Tentera Anti-Jepun Rakyat Malaya yang dibubarkan apabila tamat Perang Dunia Kedua.

Ke-9 Rejimen TPNM tersebut didirikan semula setelah penjajah British mengisytiharkan Undang-Undang Darurat pada pertengahan Jun 1948.

Pada 1 Februari 1949, PKM merasmikan Markas Agung TPNM atau Malaya National Liberation Army (MNLA). Sejak itu berbagai pasukan gerila anti-British disatukan di bawah Markas Agung TPNM.

Rejimen Ke-10 yang dirasmikan pada 21 Mei 1949 , masih peringkat dalam buaian. Tapi dengan adanya sokongan dan bantuan yang kuat dari kaum tani yang luas dan bantuan pasukan sesaudara, pasukan Rejimen Ke-10 telah tertempa dalam api perang.

Sebagai salah sebuah pasukan Tentera Pembebasan Nasional Malaya, Rejimen Ke-10 harus dengan teguh mematuhi 4 Asas Disiplin dan 10 Fasal Perhatian tentera iaitu:

EMPAT ASAS DISIPLIN

1. Segala tindakan patuh kepada perintah;
2. Tidak mengambil sebatang jarum atau seutas benang pun dari massa;
3. Sebarang rampasan perang harus dirasmikan;
4. Dengan ketat menyimpan rahsia tentera.
SEPULUH FASAL PERHATIAN

1. Pertuturan hendaklah ramah tamah;
2. Berjual beli harus adil;
3. Barang-barang yang dipinjam harus dikembalikan;
4. Ganti kerugian barang-barang yang dirosakkan;
5. Rumah-rumah yang ditumpangi harus dibersihkan;
6. Menghormati adat resam;
7. Jangan memukul atau memaki orang;
8. Jangan merosaki tanaman;
9. Jangan berlaku tidak senonoh terhadap wanita;
10. Jangan menganiayai tawanan perang.

Di samping itu, kerana keistimewaan Rejimen Ke-10 terdiri dari orang Melayu, Markas Agung menetapkan songkok khas berbintang lima yang boleh digunakan untuk sembahyang.

Manifesto Penubuhan Rejimen Ke-10

Selepas dirasmikan penubuhan Rejimen Ke-10, pejabat penerbitan yang dikendalikan oleh satu regu khas di dalam hutan telah mencetak MANIFESTO PENUBUHAN REJIMEN KE-10 dan diedarkan ke serata tempat.

Perisytiharan penubuhan Rejimen Ke-10 telah menggemparkan penjajah British dan memberangsangkan massa rakyat.

Pasukan gerila Melayu di berbagai negeri merasa sangat terdorong kerananya. Kaum tani di merata tempat di Pahang menghantar putera puteri mereka yang tersayang memasuki Rejimen Ke-10 untuk meneruskan perjuangan bangsa Melayu menghalau penjajah British. Mereka telah memberikan sokongan dan menjadi sandaran penting bagi Rejimen Ke-10. Oleh itu, Rejimen Ke-10 benar-benar bintang harapan petani Melayu yang luas.

Saya mendapat laporan dari organisasi bawah tanah dan unit pasukan bersenjata Melayu di beberapa negeri bahawa pasukan-pasukan Melayu di Selangor, Johor, Negeri Sembilan, Melaka dan Kedah sangat terberangsang setelah mendapat berita berdirinya Rejimen Ke-10. Mereka menghantar tahniah dan ada yang memohon menyertai pasukan Rejimen Ke-10.

Pada tahun 1950, Jawatankuasa Pusat PKM dan Markas Agung TPNM membuat penyusunan semula menetapkan pasukan bersenjata Melayu di berbagai negeri diletakkan di bawah riayah Rejimen Ke-10 di samping bekerjasama dengan organisasi Parti di negeri masing-masing.

Dr Mahathir, So how can a Malay lose power when it’s another Malay replacing the UMNO reject?

 Tun Dr Mahathir Mohamad today reiterated his advice for Umno leaders to discard self-interest and acts of sabotage to ensure a Barisan Nasional (BN) victory in the next general election.

 

There are two things that stuck out as very sore thumbs in the above statement. Both are never the hallmarks of UMNO. Indeed if they are practised, UMNO ceases to be UMNO. They are the elimination of self –interest and absence of acts of sabotage. Asking UMNO people not to sabotage and to disown personal interest is like asking a camel to go through the needle hole. 

 

Dr Mahathir does not only walk on water- he is also the chief spokesman of oxymoronicracy. 

 

Since the creation of UMNO Baru in 1988, every UMNO leader who has assumed the mantle of leadership has been motivated by self-interests. What’s more, they are motivated by the desire to perpetuate the self-interests, where self-preservation is top of the list. It will be interesting to investigate these fellers bank account when they are no longer in power. 

 

Sabotaging is second nature to UMNO people- by incumbents who are no longer chosen to stand or by aspiring candidates scheming and plotting to overthrow incumbents. What is absent from UMNO ? - A sense of purpose and a cause to fight for. So if we want an example of oxymoronicracy- Dr Mahathir is its foremost spokesman. 

 

Let’s dissect the substance behind the statement by Dr Mahathir in Jitra the other day. What do we make of this statement? 

 

This is a clear sign that all is not well in UMNO.  He has to reiterate. He has to remind. Someone asked me- the same question I posed some time ago, if UMNO is in dire straits, doesn’t that mean easy defeat of them?  So why bother writing about UMNO? Just ignore them. Let them destroy themselves by their won devices.

 

No can do. We write about UMNO to speed its demise. To hasten its exit from the seat of power so that the real interests of the people are taken care of. We bash UMNO because it has something that we want. Power to do good as opposed power having done evil. We are not power crazy, but we want to take away power from crazy people. 

 

All UMNO leaders and ministers are replaceable. Who can do worse than them? If Najib can become PM, this means anyone can too.

 

Now, Mahathir the man who I described as one who can walk on water- is giving out unsolicited advice. I am not sure if anyone cares to listen to him nowadays. He has contradicted himself so many times. During an interview with BBC, the interviewer read from a speech Dr Mahathir once spoke from; quoting passages from that speech, Dr Mahathir can cavalierly deny he said that.  He said that with a straight-face. Dr Mahathir is utterly honest even when he is lying.  Now that is an oxymoron. 

 

The polygraph machine doesn’t work on Dr Mahathir. Wasn’t he the one who was the chief saboteur to UMNO doing whatever he can to unseat Pak Lah? He even left UMNO as it was preparing for elections. 

 

Other than Dr Siti Hasmah, his constant companion is Ibrahim Ali. But then Ibrahim Ali’s most noticeable personal trait is his sycophancy. Ibrahim is a perennial rival to PAS’s Mat Sabu. The latter says while it’s true he isn’t good looking as Shahrukh Khan, he is a little handsomer than Ibrahim Ali. But Mat Sabu doesn’t know Ibrahim’s portrait is a best seller with padi farmers. His portrait, when placed at strategic points in padi fields scare the living daylights out of pesky birds, rodents and other pests. 

 

Just a little diversion folks. Let’s get back to the main issue. 

 

Dr Mahathir is back to the scare tactics for which he is an accomplished master. The intent of his exhortations and pleadings are clear- Malaysia is finished without UMNO and Malays are finished without UMNO. Nothing can be farther from the truth. 

 

When the Congress Party of India was defeated, that didn’t stop India from growing further, when LDP( Japan’s UMNO) lost, the Japanese rushed forward without missing a heartbeat. When Indonesia’s UMNO( Golkar) lost, Indonesia appeared to be placed on a better footing. UMNO and Malaysia is no exception. Malaysia does not depend on UMNO to survive and Malays can dispense with UMNO. 

 

We can’t depend on a party whose very future in turn depends on another person’s asshole. We can’t depend on a party whose survival depends on the continued peddling of pornographic material in the media. We can’t stake our future on a party led by a Larry Flynt. (He is the owner of the Hustler Magazine).  A most memorable quote from Larry Flynt:- wherever there is a scandal, we try to get involved. That’s UMNO for you. 

 

Now you have people like Ustazah Umi Hafilda, Ezam Mat Nor, Hassan Aqidah Ali and Zul Nordin fighting for UMNO’s cause. The dirty job by dirty people. 

 

He just doesn’t get it- people don’t want the continuation of BN administration in the country. People see BN as the perpetrator of empty promises, people see BN as the abuser of power. BN especially UMNO is the embodiment of corruption and deceit. UMNO is no longer the preferred choice as the political platform to advance the cause of the greater good. 

 

And his scariest statement of all- defeat of Umno would be akin to the Malays losing power in their own country. How can Malays lose power? If UMNO loses, the people replacing them will be other Malays. If Najib loses in Pekan, the person who defeats him is Malay. So how can a Malay lose power when it’s another Malay replacing the UMNO reject? 

 

Let’s take on Dr Mahathir in what he says? What are the elements that make up the constitution of the Malay? His religion? No one disturbs his religion. It’s enshrined in the Malaysian Constitution. It’s therefore protected by the laws of the land which no one challenges. DAP accepts that. Islam is the official religion. The position of Islam doesn’t therefore depend on the existence of UMNO. It’s protected not by UMNO but by the Constitution of Malaysia.

 

Is there anyone threatening the use of Malay language?  It’s accepted as the official language. We know language is an integral part of the Malay people. No one in their right frame of mind is against the use of the Malay language. 

 

The main ingredients that constitute the Malay- his language, his religion and his cultural make-up including the institution of the Malay rulers are protected by the laws of the land. They are not protected by UMNO. Whoever comes after UMNO are not going to disturb the provisions of the laws of the land. 

 

Just remember this – in 2004 when the Malaysian peoples gave Abdullah Badawi UMNO’s greatest victory, the people were actually rejoicing at the exit of Mahathir. Its downhill for UMNO ever since. That victory has proven to be the pride before the inevitable fall.

 Responding to the interview of his mother Che Tom Yahaya in Umno-linked TV channel TV3 over the weekend, PKR deputy president Azmin Ali wants Umno to stop dragging her into its dirty politics.

Unfazed by the onslaught against his personal life, Azmin (below) pledged to fight against the “ugly politics” nourished by Umno and its media.

“I call on media not to disturb my mother and Umno not to drag my mother into Umno’s dirty and disgusting politics.Family institution including family relationships should be harmonised and not disgraced in the media,” he said in a statement today.

“I always love and care for my mother and father. I still pray that my mother always remains in the protection of Allah, receives His mercy and in good health.

“I still love and respect my mother. I am also thankful to be awarded a wife, Shida, who is loyal, and children who understand this noble struggle,” he said.

Despite the slander from Umno, Azmin stressed that he will focus on his duty as PKR’s election director to face the 13th general election.

In the past one week, Azmin has been the target of character assassination by Umno’s media.

One FB-owner commented:

 A dastardly act by an UMNO-owned TV. It is simply unbelievable that this UMNO-led Govt could even allow itself to STOOP SO LOW to bring a MOTHER of an Opposition MP to front the TV to score political points. Any decent Malaysian who values the integrity of the family-institution will find this action as UNACCEPTABLE on ANY account.

PM Najib and Rais Yatim must stand fully responsible for this unacceptable behavior. This is a ruling party which had been in Govt for over 50 years and acted without a decent conscience. Truly, THIS Govt is scrapping the bottom of the barrel to remain in power.

Surely, it remains to be asked: Do the ruling parties of the day deserve to be still in Govt- for bringing in the mother of a Opposition political leader to score political points?  5.34pm: Home Minister Hishammuddin Hussein said that the lost police pistol has been FOUND.

He tweets:"2 policemen injured & admitted. Snatched police pistol was recovered."

5.15:  Jalan TAR - The situation in Jalan TAR appears to be calm after a FRU truck retreated. There is no police presence along the road from Maju Junction to Pertama Complex.

Some of the protesters could be seen heading back towards Dataran Merdeka.

The area in front of Bar Council building is now deserted as most of the protesters have dispersed.

But there are still protesters in two main areas - from Masjid Jamek to Dataran Maybank and those in Jalan TAR.

9.30: Jalan Tunku Abdul Rahman (TAR) - Hundreds of bersih supporters has been gathered at the back lane of Jalan TAR near Masjid India, many of them wearing Bersih or yellow T-shirts. There a group of young people who have set up a stall here to sell Bersih and 'Free Education' T-shirts. Jalan TAR and Jalan Parliament are closed by the police. While about 100 police officers form a human wall to barricade Jalan TAR, in front of Sogo, the protestors are able to evade the police by using the back lanes to go to Masjid India and Jalan Tun Perak. People are hanging around, sitting in front of shop and chatting while waiting for the protest to begin.

APRIL 27TH : EVE OF BERSIH 3.0

Friday, 27th April Night... Kuala Lumpur... Eve of Bersih 3.0 D-Day


  

Thousands of demonstrators gathered in the neighbourhood of Dataran Merdeka last night in an early warning that the crowd at Bersih's third rally may match or exceed that of the previous assembly for free and fair elections held on July 9 last year.

From 8pm onwards, hundreds, many of whom were dressed in the electoral reform movement's yellow uniform, began to gather into groups on streets including Jalan Sultan in Chinatown as well as Jalan Tun Perak and Jalan Raja which lead to the historic square.

By 11pm, the group near Dataran Merdeka easily surpassed 1,000 according to numerous eye-witness reports although those at Jalan Sultan dispersed around midnight after an impromptu rendition of Negaraku, the national anthem.

Although many had dispersed by 1am, many were still turning up after that. "Everybody wants to be closest to Dataran" when the rally starts proper, said one participant.

Bersih co-chair Datuk Ambiga Sreenevasan told The Malaysian Insider early this morning "the Bersih feeling is in the air in Kuala Lumpur."

"It is a feeling of purpose and of hope. As we gather later today we will speak with one voice in claiming what is rightfully ours... democratic space, clean and fair elections and a clean environment. We will also claim back the right to shape our future," she said.

My name is Yolanda Augustin.

I left Malaysia 14 years ago to study in the UK, where I now live and work as a DOCTOR.

I’m writing to explain what inspired me to get involved in the Bersih movement and global solidarity work for Malaysia.

For many years, I felt a sense of helplessness and frustration as I followed Malaysian current affairs and saw the country I grew up in stuck in a downward spiral of poor governance and deteriorating civil liberties and human rights.

What really got to me was the complete waste of potential – Malaysia was and remains a beautiful country – rich in natural resources, great weather, fantastic cuisine and diverse culture. It has a small population of 28 million people that could enjoy a world class healthcare and education system if the money spent on hapless vanity projects and siphoned off to fund the multimillionaire lifestyles of government ministers was spent on improving the lives of the rakyat.

I was also struck by the vast number of Malaysians I met living overseas – many of them doing interesting and inspiring things – writers, scientists, entrepreneurs, doctors, chefs, bankers, lecturers, lawyers, nurses, town planners, engineers, actors, the list goes on.

Many of them still with strong roots and a sense of connection to their place of birth. Many of them wanting to contribute something good and positive towards Malaysia but not knowing what, where or how.

People would often ask me if I ever planned to return to Malaysia one day. I would usually smile and say “One day…when I finish my training… but not yet.”

The truth was that as much as I was often homesick and nostalgic for the country I grew up in, living abroad had changed my life and my mindset. I appreciated the freedom to move, think and speak as I pleased, without a psychological straight jacket, without the risk of the ‘guillotine of the Internal Security Act’ (or newly rebranded Special Security Offenses Bill) as Hishammudin Rais calls it continually hanging over my head, where overnight the special branch who have been following your every movement for months from a red Proton Saga can break into your home, kidnap you and tear the fabric of your life, and that of your family and friends apart.

I appreciated living in a place where archaic pieces of legislation such as the Press and Printing Act didn’t keep the press muzzled, making newspapers not worth the paper they were printed on, where the press kept the politicians in check, not the other way round.

I appreciated living in a place where critical thinking and debate were encouraged, where students were not arrested for peaceful protest, where freedom of speech and assembly were part and parcel of everyday life.

In my student days I had been part of a London solidarity anti-ISA campaign, sparked by the arrest and detention of those involved in the 1998 reformasi movement. A small group of 5-6 of us used to picket outside the Malaysian tourism Office in Trafalgar Square during our lunch hour. It was a nice gesture but it all seemed pretty depressing – Malaysians in general seemed to be plagued by a sense of inertia and a general unease that Special Branch Big Brother would catch them (even all the way in London) if they dared tell the government to start behaving itself.

Then in 2010 I met a group of like minded Malaysians in London, many of whom have since become great friends, and we started a series of solidarity protests again, to give support to our brothers and sisters in Malaysia who were tirelessly campaigning on various human rights issues and to form a pressure group aimed at holding the Malaysian government to account for their pitiful human rights record.

It was incredibly encouraging to see the solidarity movement grow from 10 to 20 to 50 regular attendees.

I mean – these are MALAYSIANS we are talking about – and we are generally not used to challenging authority or protesting (particularly not in freezing just above 0 degree temperatures!).

In June 2011 we joined in the global solidarity campaign for Bersih 2.0 and it was awe-inspiring to see Malaysians from over 30 cities around the world stand in solidarity with over 50,000 fellow Malaysians in KL to support the call for free, fair and clean elections.

In London we had expected around 100 people to turn up, 150 if we were lucky. When nearly 500 Malaysians gathered in front of the Malaysian high commission in Belgravia we were gobsmacked. Across 5 continents the global Bersih 2.0 fire had been lit and there was no stopping it.

The ridiculous antics of a panicking government – arresting over 1500 civilians, many for as little as wearing a yellow t-shirt, the detention of 6 activists under the Emergency Ordinance, the tragic death of 1 rally supporter, the unleashing of water cannons and tear gas on peaceful demonstrators, in one instance even into the confines of a maternity hospital, failed to snuff out the ‘unggun Bersih’ (flame of Bersih) as Pak Samad so aptly calls it.

It had exactly the opposite effect – merely igniting the flame further. Peacefully, sincerely and with quiet resolve – Malaysians around the world came together, with their own small but significant acts of peaceful resistance – to remind the Malaysian government and the world that it doesn’t have to be this way.

Free and fair elections are the essential building blocks of any open and mature democracy. It is our right to demand it, and we should expect no less.

An aunt wrote to me in the aftermath of Bersih 2.0 to explain what had inspired her to join the Bersih rally in KL. She put it simply, “July 9th 2011 will forever be etched in my mind as the day I decided to stop being afraid.

My daughter was adamant about going for the Bersih rally in KL and she went in on Friday evening with friends from the Women’s Aid Organisation to stay at a hotel in Bukit Bintang. I felt then that our generation had let our kids down and we were expecting them to move mountains by cleaning up the mess. It really was time to do something, no matter how minimal.”

This Saturday the 28th of April 2012, Global Bersih 3.0 solidarity actions will be taking place in over 70 cities in 29 countries around the world.

We urge Malaysians the world over to take part and stand up for free and fair elections and civil liberties in Malaysia – because we CAN. The time has come for Malaysians the world over to do something, no matter how minimal.

That time is NOW.

The Malays are lost and waylaid and at the crossroads of a really serious Malay dilemma.

Check out our beloved Chow Kit Road, and see who owns the thriving commerce? Or visit the Pudu wet market and see who is shouting for customers at 4 am (even before the cock crows).

Half the businesses now are with the foreigners, another half with other races, the Malays only have land titles left (especially reserve land of no value). All the GLC's are still in Malay hands, but not for long; otherwise all will be sold off in no time at all.

As a people, the Malays are not known for perseverance and enduring commitment. They have no business acumen. Being entrepreneurial is a steep climb for them and the Malays have no stamina to stomach the strains and stresses.

I speak from experience. They are easily swayed by circumstances.

More than half our local workforce are pendatangs (Indons, Myanmars, Nepals, Vietnamese, Banglas!)

This country is not only bankrupt as said by Idris Jala, but also - telah dilelongkan. The poorer of the majority Malays left behind will become beggars and mat rempit, mat gian, mat ragut and mat dadah (they are all subsidized by our government funding to buy their No 1 drugs of escapism to run away from a harsh reality - Metadon).

Who culled their own Malay race? Nobody but UMNO-BN itself! I rest my case.

Strategy of mind control



Since 1957 UMNO has effectively carried out the population engineering of our country to ensure its own long-term survival by creating the myth of a two-pronged “Ketuanan Melayu” strategy of mind control.

“Ketuanan Melayu” for the majority Malay masses who are lulled and numbed into a feeling of being superior over the non-Malays because of their demographic numbers; and “Ketuanan Melayu” for the favored UMNOputra Malay political elites through the accumulation of massive material wealth and power for themselves and their cronies.

And while UMNO has failed by almost any measure you chose to gauge them – good governance, ethics or morality – without question they have succeeded too well in the social engineering exercise after the bloody race riots of May 13, 1969.

The duplicity of UMNO in proclaiming 1Malaysia - Satu Bangsa, Satu Negara -while all the while undertaking a relentless program to whittle down the numbers of the non-Malays through a very precise and focused political initiative is breathtaking in its effectiveness!

Consider this -

In 1957:

– 45% of the population were Chinese

– 12% of the population were Indians

In 2010:

– 25% of the population are Chinese

– 7% of the population are Indians

Over 600,000 Chinese and Indian Malaysians with red IC status were REJECTED repeatedly when applying for citizenship and possibly 60% of them had passed away due to old age.

Since 1957:

– 2 million Chinese have EMIGRATED

– 0.5 million Indians have EMIGRATED

– 3 million Indonesians came over to Malaysia to become Malaysian citizens with Bumiputra status even if they stay LESS than 5 years. (Nett gain 0.5 million and an additional of 3 million manufactured Bumiputras like Muslim Indonesians).

The most famous is none other than Mohd Khir Toyo who stayed for 20 years but became MB of Selangor.

Chinese population to dwindle and the Indon to rise

In the not too distant future INDONESION migrants, owing to the virtues of hard work and thrift taught by their parents, or grandparents, would have surpassed the majority MALAYS in terms of socio-economic progress.

Mohd Khir Toyo is smarter than most local-born Malays in terms of amassing his personal wealth at the shortest duration of time. Even Muhammad Muhammad Taib is no match for him. That's how smart Khir Toyo is.

Instead of teaching their people the virtues of hard work and perseverance, the UMNO warlords are proclaiming Ketuanan Melayu to feed off the Chinese minorities like parasites.

If not for the Chinese taxpayers, the Malays will be sleeping the five foot-ways.

Of course the Chinese isn't a threat - they are just workaholics - they want to create wealth and prosperity so much so that no failures of any kind is going to stop them. Not even the ultra Malay racists spewing blood in their eyes or frothing venom in their mouths.

It is envisaged the Chinese demographics will dwindle to stabilize at 4 percent of the overall Malaysian population but their accumulated wealth and economic power will continue to rise to more than 75 percent of the overall GDP of the country.

That’s proof enough how steady and influential the Chinese economic stranglehold over the majority Malays will become; and we believe racial hatred and resentment is well likely to remain for the next 50 years.They work hard for the money but we envy them in our idleness.

Whereas the Indonesian newcomers went out to work BEFODRE you become awake and they are not home yet when you call it a day and went to bed. Will the majority Malays consider them a threat when they deservedly find new wealth?

The Indonesians respect the Chinese for their business acumen and diligence. Do the Malays think likewise if not indulge in unguarded jealousy and envy?

Best to lay the blame where it belongs - NOT the Malays, but UMNO

Now the non-Malays are well aware of this tinkering and engineering of our population and it would do us Malays no good to say that it was UMNO’s doing and that we had no hand in what happened at the end of the day.

As a Malay I was then comfortable that UMNO was the dominant partner in the Barisan Nasional. It was indeed comforting to know that Malays controlled four of the five major banks. We were also in control of UMBC, MISC and Southern Bank – all previously owned by the Chinese.

But seemingly the Chinese-owned Public Bank which is not in our control is moving ahead of the others still in economic prowess and competitive skills. What’s wrong with our control?

Education?

Between 1968 to 2000:

– 48 Chinese primary schools SHUT DOWN

– 144 Indian primary schools CLOSED

– 2637 Malay Primary Schools were BUILT

Of the total government budget for these schools, 2.5% were for the Chinese, 1% for the Indians and a whopping 96.5% for the Malay primary schools.

The fact that 2637 Malay primary schools were built between 1968 to 2000 implied that the engineered process of RETARDING our majority Malays or bumiputras is getting obvious.

At the end of their school lives, they have nowhere to go except to stay put in this country, as like idiots they have nowhere else to go because everywhere they are faced with a serious language problem and a communication breakdown with others.

They will, like it or not, have to support the Ketuanan Melayu concept to survive for their freebies or welfare. The mentality is - No need to work and money will still come.

Scions of the rich and wealthy UMNOputras will be educated overseas and return to continue to rule over their poorer local cousins.

Petronas petrol stations?

Of the 2000 station the Malays owned 99%. Yes…we the Malays were indeed in control.

In control of what?

1. We were in control of all the business licenses and permits for Taxis and Approved Permits (APs).
   
   
2. We were in control of Government contracts of which 95% were given to Malays.
   
   
3. We were in control of the rice trade through Bernas that bought over 80% of Chinese rice millers in Kedah. Even Robert Kuok aka Sugar King was forced to sell his sugar franchise to UMNO crony interests so that the Malays are deemed to be in control of the sugar market; and the other essential basic items.
   
   
4. We were in control of bus companies. Throughout Malaysia, MARA buses could be seen plying all the routes.
   
   Non-Malays were simply displaced by having their application for bus routes and for new buses rejected. Many local Chinese owned bus companies are already kaput in the urban centers.
   
   
5. Every new housing estate being built had a mosque or a surau.
   None, I repeat “no” temples or churches were built for any housing estate even if the majority residents are non Malays!
   
   We even blare the loudspeakers in every mosque calling for Azan at maximum volume just so to tell the non Malays and non Muslims that we are in control!
   

How come still poor with so much control?

So why with control over all these highly visible entities and business opportunities are the majority Malays still unable to stand tall and with pride over and above the non-Malays?

We are unable to so do because it was not the Malays that benefited from these opportunities - only the favoured UMNOputras enjoyed the benefits, and the poorer among the majority Malays were merely taken for a ride as their name were used by UMNO to hijack the national agenda.

The Chinese bogeyman and the Malay hobbyhorse work wonders for UMNO to play one against the other in their evil scheme of Divide and Rule to suit their survival plan.

Another video uploaded as KFC punch-up riles Malaysians

Instead of abating, a video of a customer being punched by staff of a KFC outlet in I-City, Selangor, has attracted even greater public outcry. Other customers who were present and filmed the punch-up are starting to send in their footage to Segambut MP Lim Lip Eng.

"This is the second video taken by a customer who was at the I-City KFC fight fiasco," Lip Eng said on his Twitter.

Churlish and unprofessional

The second video confirms the view of many that the KFC staff had behaved churlishly towards Ng Chee Fei, who had gone to the restaurant with his wife on February 6.

According to Ng, he and his wife were made to wait at the KFC outlet for an hour before being rudely told "‘ayam sudah habis, apa you mahu lagi?

Angered by the sloppy service, he ticked off the staff and a shouting match ensued. According to his wife, some of the staff even brought out a steel bar to threaten them.

Although she managed to pull her husband away, he refused to be brushed off and re-entered the outlet, demanding their names so that he lodge a formal complaint. It was then that one of the staff punched him in the face, while the outlet manager stood by and chatted the others.

'Racialisng' what was basically terrible customer service

Some of those present filmed the incident, and one of them uploaded the video on You Tube, where it became viral. Anxious to downplay the violence displayed by the staff, some cyber-troopers who seem to be Umno supporters began tagging the incident as an outbreak of Malay vs Chinese animosity. Ng was also accused of being an 'arrogant Chinese'.

This led Ng to seek legal advice and lodge a police report over the incident. At the police station, Ng was advised not to approach the Pakatan Rakyat with his story 'in the spirit of 1Malaysia'.

However, given the deafening silence from KFC, which has yet to offer an apology or words of comfort, Ng decided to approach Lip Eng for justice. KFC is an Umno-linked frim.

"I won’t go back to KFC, not for a long time, I’m mentally distressed,” Ng told a press conference on Thursday.

“This is no reason for physical attack. I did not hit back because violence is not the answer. Rumours that I was drunk when the incident occurred are also not true."

Spare the rod and spoil the child

All eyes are on whether KFC will refuse to call for an inquiry into the conduct of its staff. All eyes are also on the police to see if they will take any action at all.

There is also some expectation that ultra-Malay rights group Perkasa and its founder Ibrahim Ali may be roped in to speak on behalf of the KFC staff.

Hasan Ali - Thank Goodness, He Didn't Appeal!

A long time ago, when you mentioned Hasan Ali’s name, there was some respect for this PAS leader even though he was basically another self-proclaimed defender of Islam. Respect was extended to him for his Islamic standing and that was mostly due to his position as the head of PAS Selangor.

Less focus was placed on his persona, educational background but mainly he was held in esteemed and given face because he had been handpicked by PAS to defend the Muslims in the state, and perceived to be performing his religious duties to uphold the good name of Islam.

But things changed. Something happened.

Even from before 2008, Hasan was interested in UMNO

Rumours and wild talk started to surface after the last election in 2008. Hasan Ali started to become prominent for other reasons. From religion, he started to move into race-championing.

Talks of secret meetings between Hasan Ali and UMNO to form a new Selangor government under Pakatan Rakyat finally came out into the open.

PAS had to issue a denial, and its president Hadi Awang had to make a clarification. Within PAS, the blurred lines between the party's liberals and the ultra conservative ulama or religious heads began to take shape and sharpen. Along with Pakatan, PAS was shaken and stirred by the Hasan's dealings with UMNO.

It was no secret that Hasan harbored dreams of becoming the next Menteri Besar and was willing to sleep with the devil just to deny a Pakatan Rakyat government in Selangor.

Since then, he has in the news for all the wrong reasons, and oftentimes people wondered whether he was representing PAS, Pakatan or UMNO!

The beer fiasco in Shah Alam’s minimart left a sour note on people’s lips. Non-Muslims started to watch him with a wary eye and avoided him like the plague.

Christian-bashing

Later on, when he leveled accusations at the Christians for attempting to proselytize Selangor Muslims in the Damansara Utama Methodist Centre, it confirmed everyone's worst fears. Hasan was like Ibrahim Ali - a political lunatic running amuk and ready to do any extreme act just to reap some gain from UMNO.

The DUMC-JAIS raid affected more than Selangor. It left a lasting negative impression on the whole country, especially Sarawak where 43% of the people there are Christians. Surprisingly, BN politicians seemed unaware of the horror the two political 'pyschos' were creating.

In fact, BN leaders  sided with Hasan even though he was then still in PAS. It was starting to become obvious that Hasan might straddling two 'sampans' or long-boats at the same time.

But to Hasan, he was like a white knight in shining armour, fighting against the purported proselytization of Muslims in the state. Somehow he could not convince the Muslims he was sincere. The majority saw him as just another political opportunist. Soon, the daily attacks against the Christians and declarations that his actions were for the good of Islam began to fall apart.

Thank goodness, he didn't appeal

As he spoke about Islam, or the version that he practiced anyway, others were already discussing his defection to UMNO. It was a matter of when and in what manner - the possibility was never even questioned!

Thus, it was not a surprise when PAS finally sacked him. Everyone knew he had it coming. In fact, he worked hard to force PAS to sack him.

Seduced by flattery from UMNO, it is likely Hasan believed that PAS wouldn’t have the balls to dump him. Still reeling from the aftershock of his shameful sacking, he has embarked on a roadshow to educate the public on the political parasites in PAS, who was partly responsible for his sacking. And guess who is tagging along with him? None other than Ridhuan Tee, the faithful Muslim.

The appeal period for Hasan Ali has expired and he has declared he has no intention to appeal. The sighs of relief are loud indeed along the corridors of power in PAS and Pakatan.

If he had appealed, it would have put the coalition and the party in a slight pickle. They would have looked bad if they rejected him. But if they re-opened the door to him, and he started his nonsense again, they would look weak and foolish - much like our Prime Minister Najib Razak!

Parasites

Talking about parasites, Hasan Ali failed to observe that most parasites are so tiny, like the lice in one's hair that most do not notice. As far as the public knows, there are only 3 parasites with ravenous blood-sucking traits that are of some 'entertainment' value. So well fed are these parasites, they have turned into hideous overweight monsters like Jabba the Hut in Starwars.

One of them is a chronic and confirmed party-hopper. This guy owes allegiance to no one and his master is whoever pays him for the moment. Though he contested on a PAS ticket, within months of winning, he turned Independent and then formed Perkasa.

The second lost his position as the number 2 in PAS last year.

The third one didn’t realize that he was a parasite and has embarked on an educational tour to expose himself!

And to top it all, all of three of them were present at a recent press conference in honor of Parasite No. 3's sacking. Were they there to lend support to him as a fellow parasites, or to wallow in glee at his sacking?

Political ambitions

Now, Hasan says he wants to form a new NGO called JATI to fight for Islam, Malay Rights and the Malay Rulers. What a noble cause, if it only were true. Already there is Perkasa and Perkida and these 2 organizations must be sleeping if there is a need to form JATI.

Hasan clearly still harbors political ambitions, positioning JATI as the Third Force. So confident is Hasan that he has already rejected the lures thrown out to him by KITA. But there is some shadow-play there and although for ex-UMNO minister and PKR turncoat, Zaid Ibrahim, has announced plans to dissolve KITA, some are betting that eventually peace will be made and Hasan will go into KITA although Zaid may make an exit after doing his national service for UMNO.

So one way or another Hasan looks sets to become a rusty fixture, much like Ibrahim Ali, Zul Noordin and Zahrain Hashim. His JATI can even apply for its own license to become the nation's newest political party.

Then he can field himself and other like-minded specimens in the next election, because while UMNO may support him, they won't touch him with a 20-foot barge pole. Apart from KITA, no one else would!

Hasan has finally shown his true colours and it's not green like those little green men from Mars. Instead of seeking forgiveness from the Party that gave him an illustrious career, he sees it fit to back-stab his former colleagues. Memang kartun or a real cartoon, is how they now view him. But this modus operandi will doom his new career as Zaid will tell him.

Zaid too had embarked on a 'politics of revenge' against Opposition Leader Anwar Ibrahim. But the slandering and washing of linen in public only put Malaysians off Zaid. From a high perch as a Malay intellectual, Zaid was finally perceived to be just another political pirate doing the rounds for UMNO. The very same is taking place with Hasan, though he doesn't see it or chooses not to see it yet.

Another failed UMNO tactic

Obviously, if Hasan has new backers, he must show them the benefits of taking him on-board. How can he blow the whistle on himself? For example, how can he tell UMNO - you guys were stupid to pick me!
So, acting like a crusader and trying to pick a fight with the Christians whom he regards as the enemy, Hasan is out to conquer the country with yet another out-of-favor and shelf life-expired cocktail of racism and religious bigotry.

Hell-bent to rouse the flames of controversy, Hasan will put the blame for his misfortune on the peace-loving Christians in this country whom he thinks will not dare to retaliate. Hardly the hallmark of a man of Islam!
By now, no one in PAS is angry anymore at Hasan's sacking.

The real Hasan Ali has stepped out from the shadows and he has sprouted horns. No doubt about it, like Ibrahim Ali, Hasan Ali is a boon to the Pakatan Rakyat.

The more the 'Alis' rant and holler, the more Malaysians will sympathize with Pakatan.

Whoever in UMNO dreamed up this diabolical scheme to back stab PAS has now been back stabbed by himself! Really, they should think more carefully and not rush to grab off the shelf items that may not work or are defective. No point to behave like a bull in a China shop, but perhaps this is an indication of how bankrupt UMNO is of new ideas.

What their strategists are doing is like the Malay saying,  tak sa takut! Gostan saja. Jika langgar, pasti ada bunyi

A ceramah organised by Anything But Umno (ABU) was cancelled at the last minute due to a disturbance from a "rowdy" group.

According to Suara Rakyat Malaysia (Suaram) executive director E Nalini (right), the ceramah was disrupted by several youths sporting T-shirts with BN and Umno logos.

"The ceramah was to start about 9pm last night. As we were driving to the hall, there were about six or seven men beating up a boy with sticks," said Nalini.

This was confirmed by ABU coordinator Haris Ibrahim, who added that one young man was taken to the hospital.

"Another group of some 20 people were causing a ruckus opposite the hall, waving rods and riding motorcycles," Nalini told Malaysiakini, adding that they were told the area was an "Umno stronghold".

Co-organised by Hindu Rakyat Action Force (Hindraf), the ceramah was to take place at the Shah Alam City Council (MBSA) Hall on Jalan Kebun, before it was called off over safety concerns.

"I understand that the hospital had to do a CT Scan on the youth. He is out of danger but he is certainly traumatised," said Haris, who was to speak at the ceramah.

Apart from Haris, other speakers lined up were PKR's Badrul Hisham Shahrin, PAS deputy president Mohamad Sabu and Hindraf national coordinator W Sambulingam.

Haris said the organisers would decide later today on their next course of action.

Nalini said that the rowdy group dispersed after several police patrol cars arrived at the scene.

Malays told to leave

Hindraf adviser N Ganesan said in a statement that the group was making a racket outside the MBSA hall by honking motorcycle horns, and one of the group's leaders even told Malay attendees to leave the ceramah.

"Having succeeded in getting a few of the attendees to leave the hall, the mat rempit then began kicking and pushing over the publicity material and tables placed at the entrance to the hall.

"This made some in the crowd restless, and prompted the mat rempit leader to ask the crowd to 'berambus' (get lost).

N Ganesan, HRP advisor June 4"Things took an ugly turn when a mat rempit then rode his motorcycle right into the seating area, making those there scramble for safety," recounted Ganesan (left).

A scuffle then took place when one of the participants told the motorcycle group leader to leave.

They began shoving one another and it eventually ended in a fight, said Ganesan, adding that the participant was then "knocked senseless, and had to be rushed off to the hospital".

Ganesan also criticised BN and Umno, accusing them of using youths to disrupt the ceramah.

He added that despite the "brazen attempt" to thwart the gathering, Hindraf as well as ABU would continue to host forums and ceramah of such nature.

However, Selangor police chief Tun Hisan Tun Hamzah refuted the allegations that a person was injured.

"NOTHING happened, the residents were unhappy, that's all. NO BN or Umno supporters disturbed them," said Tun Hisan when contacted.

"No police reports were lodged, not even by the victim who was said to be injured," he said.

"Papagomo" aka Wan Muhammad Azri and "Parpukari "aka Mohd Salim Iskandar sued for RM 10 Million for Defamation .

Pro-Umno bloggers Papagomo and Parpukari are facing a looming RM10 million lawsuit each for allegedly defaming businessman Abdul Razak Mohd Noor.

Abdul Razak had through law agency Netto & Co on Jan 3 issued a letter of demand to the duo, on top of a notice of demand published in a major local daily last Saturday.


When contacted, Abdul Razak's lawyer Reuben Netto said his client had resorted to public notices as he had no other avenues to defend himself.

"When we go before the judge, we want to say that we have done everything in our power to identify the bloggers," he said.

The notices names Wan Muhammad Azri Wan Deris as the owner of the Papagomo blog and Mohamad Salim Iskandar as the owner of the Parpukari blog.

Abdul Razak claims that Papagomo had through a blog posting on Dec 11, 2011 and Parpukari through a blog posting on Dec 4 and Dec 12, 2011 defamed him.

"They have defamed my client by calling him a conman and accusing him of cheating the government, saying that he had collaborated with the opposition and labelling him as being ungrateful to Umno," said Netto.

Justifying the demand of RM10 million in damages, Netto said Abdul Razak holds all telecommunications licences relating to broadband and satellite services in partnership with Telekom Malaysia.

"He is supplying the Malaysian public with broadband services in cooperation with Telekom, he is a fairly big person in terms of the services he renders. But with these defamatory articles, the banks and Telekom are calling up my client and asking what is happening," he said.

Netto said he was informed that Papagomo has met with other bloggers and sought advice on how handle the looming suit, while Parpukari thus far has ignored the legal notices.

Court action expected soon

"If by the end of the week, they do not show any sincerity or overtures in writing, then it will force our hand to file an action in court," he said.

Aside from damages, according to the letter sent on Jan 3, Abdul Razak is demanding for the duo to withdraw their allegations from their blogs as well as, at their own expense, request similar withdrawals from sites that have circulated the claims.

He is also seeking for the two to publish an unqualified apology on their blogs and to seek similar publication on sites which have circulated their allegations.

The duo will also be required to put in writing a guarantee to not publish similar allegations or imputations against Abdul Razak in future.

If the bloggers do not respond, Netto added, a suit will be filed at the Kuala Lumpur High Court as early as Friday and the latest by early next week.

Papagomo has in the past made several controversial claims, including alleging that Penang Chief Minister Lim Guan Eng's son had outraged the modesty of his schoolmate, a claim which has been proven untrue. READ HERE FOR MORE

The High Court today acquitted Datuk Seri Anwar Ibrahim of a charge of sodomising his former male aide Mohd Saiful Bukhari Azlan.

Judge Mohd Zabidin Mohd Diah ruled that the prosecution had NOT DONE ENOUGH to prove Anwar had committed sodomy against Saiful.

“After going through the evidence, I cannot be 100 percent certain that the evidence could have been compromised.

Hence, the court is reluctant to convict on such corrobaration of evidence from SP1 Saiful.

The court does not exclude the possibility the (DNA) samples were compromised. Therefore the accused is acquitted.” he ruled to shouts of joy from Anwar’s supporters and family.

Anwar, a former deputy prime minister was charged with sodomising Saiful at the Desa Damansara condominium between 3.01pm and 4.30pm on June 26, 2008. He had been similarly indicted of sodomy over a decade ago and was found guilty. He spent six years in jail before being exonerated.

Anwar's wife Dr Wan Azizah Wan Ismail cried and hugged her elated husband.

In an immediate reaction, Anwar thanked his lawyers.

"I'm finally vindicated after the smearing of my character. I'm thankful to Wan Azizah and the team of lawyers led by Karpal Singh."

He also thanked the support of Pakatan Rakyat leaders.

"We want to continue on the reform agenda, fighting corruption, and freedom of the press."
